Can I afford to pay the meher amount and 2 dinar gold if I give talaq to my wife?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
During my marriage in nikahnama the meher amount has been written more i.e 4 Lakhs and 2 dinar gold.As our family doesn’t know Urdu language the father in law took advantage of this and got it signed in nikhanama during nikah. Now i want to give talaq to my wife, should i pay all the meher amount and 2 dinar gold to her.(Actually i dont earn more than 12000 per month, how can i give so much amount)

Answer

(Fatwa: 1555/1555/M=1431)

You should have settled the matter of mahr at the time of nikah or before it. When you accepted the nikah on the said mahr and signed the nikahnama, that mahr became due on you. If you have met your wife in privacy or have intercourse with her, you will have to pay full mahr. If your wife withdraws her right of mahr happily without any compulsion, it shall be remitted; otherwise, it is wajib on husband to pay it. Talaq is disliked in Shariah; therefore one should not give talaq to his wife except in inevitable circumstances.
