Is it permissible for a husband to deny his wife’s son money from her business in Islam?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Assalamu AlaIkum Warahmatullahi wabarakatuhu, I have 21 years old son from my first marriage, who lives with me and goes to college. My first husband has passed away. I have married to a married man has his own family. He lives with his family, but comes every week. I had a business from my first marriage and now my husband runs it. So far I have worked and paid all the bills. Now I am not working from four months, my husband says that what ever I made belongs to him. He denies giving it to my son. Is this right by Islamic way? Please send me your fatwa for this situation. May Allah reward you for this?

Answer

(Fatwa: 1127/971=B/1429)

When the woman owns as usual all the business then she is the legal owner of it. Yes, the husband will be given the wages as per his work. Therefore, it is unlawful on part of the husband to deny the right, and whatever the expenditure and profit was obtained is for the woman.
