Answered as per Hanafi Fiqh by Darulifta-Deoband.com
ASSALAMOALAIKUM RESPECTED MUFTI SAHIB I have a question. Please do not put my name or e-mail on the internet. I want to buy something from my deceased father’s estate worth ten thousand dollars. My father is survived by his wife,6 daughters and 3 sons including me.The wife is all the childrn’s mother. Since I am buying I do not get counted. So can you tell me how this money should be distributed ISLAMICALLY? SHUKRAN

Answer

(Fatwa: 931/914=D-1429)

If legal heirs of the late father are: a wife, six daughters and three sons, then all the assets like cash, moveable and immoveable properties will be divided into 96 parts; out of which 12 parts will be given to wife, 14 parts to each son and 7 parts to each daughter.

Two impartial and expert men who have experience to evaluate the articles and properties should estimate those things and then distribute them as per their price. If any dispute ensues between two or more, then it should settle down by a lot. Afterwards, when the heirs possess their shares, you can buy it from any heir (if he is willing to sell) on mutual rate.
