Can I receive commission based on monthly salary or sales?

I want to know that can I take commission remuneration on sale) of sales from seller. Suppose if a seller said to me that if you sale my goods by customer or brings customers for purchasing at my shop, then I promise to you that I will give a certain amount or percent of sell (e.g. 10% of total sell). Please tell me shortly for this separate situation. (1) If commission of sell is on the basis of monthly salary and sells is target basis by month. (2) If commission is on the basis of sales.

Answer

(Fatwa: 30/17/N=1433)

If the time and compensation is fixed along with the work that you would do so and so work so and so hours daily and will take so and so monthly salary then this dealing shall be lawful without any doubt provided the customer is not deceived with false statement or lie:

(2) This is also lawful.
قال في خلاصة الفتاوى (كتاب الإجارات الفصل الثاني الجنس الخامس 3 : 116) : وفى الأصل : أجرة السمسار والمغاري والحمامي والصكاك ومالا تقدير فيه للوقت ولا مقدار لما يستحق بالعقد لكن للناس فيه حاجة جاز وإن كان فى الأصل فاسداً اهـ
