Should we give a “Dum” for kissing after returning home without cutting hair?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Dear Moulana Sahib, Assalamoalaikum, I live in Jeddah with my wife. We went to perform Umra. We completed the Tawaf and Saee. After that, my wife wanted to cut her hair herself but I told her that only someone who has already got Halaqa can cut your hair. She waited for me so I can get my haircut and then cut her hair. After I had my Haircut, we discovered we did not have a scissors to cut her hair. We thought we can go home (Jeddah) and do that. Once we returned home, we kissed each other. Immediately after, she remembered that she needed to cut her hair. Now, please advise us if we should give any “Dum” having done this? If so, what should it be? and can we give Dum back in Pakistan where people need it the most?

Answer

(Fatwa: 1651/L=470/tl=1431)

It is necessary to cut or shave the head hair in the boundary of Haram. In the above-mentioned question your first mistake was that you cut the hair of your wife outside of the Haram boundary that made a dam (slaughter of animal) wajib on your wife. The second mistake committed by both of you is that you kissed each other in the state of Ihram that made a second dam wajib on your wife. A dam that becomes wajib due to jinayat (mistake) it is necessary to slaughter it in the boundary of Haram. It will not be valid if done on any other place. Hence, your wife should arrange the qurbani of two animals in the Haram boundary. Dam shall not be valid if it is done in Pakistan, rather it shall remain due on her.
