What is the Islamic ruling regarding Mahr if it is returned by the Groom’s family during a Khula (Talaq Baain)?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
As’salmu alaikum. Further to fatwa No. 8489. 1. What is the ruling if the Mahr is returned by the Groom and family, even without being asked by the Bride’s family during a Khula (Talaq Baain) 2. Should the gifts presented to Bride during and after Nikah be returned to grooms family after Khula? What is the shariah ruling?

Answer

(Fatwa: 36/32=B/1429)

Khula is a divorce given in return of mahr. If husband pays back her mahr it is benevolence on his part, she can use it. The things given as gift should not be taken back.
