Is private ownership allowed in Islam?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Assalam-o-Alaikum, my question is, what is Islamic point of view of Private ownership. I believe that Islam has no place for Capitalism and also not for Communism, but is Private ownership allowed in Islam???? 1) What other Fiqh’s stand point on this? 2) is this true: once when hazrat sindhi was in india a muslim student came to him and said that v learnt in skool that a religion which believes in private property should be destroyed. hazrat sindhi said ‘i agree’ and he qouted quran ” oh u who believe shall i not guide u to a trade that will save u from a painfull torment that u believe in Allah and that u strive hard in the cause of Allah with ur wealth and lives ….” 3) Did Caliph Umar gave the verict that no one can own land it is a contract b/w the faqrmer and the state? 4) Does qadoori book of mazariat mentions that according to imam abu hanifa no one own land? 5) whst the stand point of Shah Waliullah, did he say in his book hujat ullah hil baligha that Allah is the true owner of land and state shall be cutodian of the land. In izzalatul khifa, did he he gives qoutes for the dalail of hazrat umer in support of state ownership of land?? Stateownership is Communism. I am so confused please please help. I will be really thankful. Please answer my all questions and sorry for the long question. Please solve my confusion.

Answer

(Fatwa: 1527/1188=H)

(1) Private ownership is allowed in Islam.

(2) We do not know this discussion; neither had we seen it anywhere nor did we hear it.

(3) We do not remember such a verdict.

(4, 5) We did not see this thing directly in Qudoori, Hujjatullah and Izalatul Khifa. Please, write down the texts then only we can have a say in the matter. There is a booklet “Islam ka nizam-e-Taqseem-e-Daulat” published with the second volume of Jawahirul Fiqh by Hazrat Maulana Mufti Shafee. This book deals with the subject nicely. Study it from beginning to end repeatedly with concentration, and then ask if you have any question.
