Assalam. In a Gujerat village Abida, being deserted but not divorced, by her husband lives with her brother with her one daughter. brother brings up the child and gets her married with his son Iqbal. Husband Ibrahim has married another wife and has children by her. Its 30 years now, and Abida wants her maintenance and marriage expenses for her daughter from her husband Ibrahim. Ibrahim is a landed farmer and is about to sell some of his land. Pl. give a fatwa, how much money should she get? JazakAllah Khair!
Answer

(Fatwa: 377/346=B/1430)

If the husband drove away his wife and did not give her talaq and maintenance too, then she can demand her maintenance from him. Also, the father of the girl is responsible for all expenses of upbringing up to adulthood and marriage. The husband has committed a grave oppression and sin, and he shall reap its consequences. Some prudent persons should sit together and decide about the amount of the money.
