What is the Islamic ruling on inheritance in this situation?

c I have one grandson and one granddaughter by each of my son and daughter. My sister has two daughters, one married to a Jain and the other to a Hindu who have three sons and two daughters respectively by them. Kindly give your fatwa as to how the property left by my late brother Nazir shall be divided?

Answer

(Fatwa: 1208/773/L=1432)

If your parents are not alive and your late brother had no wife and no children then all the property of your deceased brother shall be divided into 3 shares, out of which 2 shares shall go to one brother (you) while one share to the sister. Your son, daughter, grandson and granddaughter etc shall get no share in his property. The detail of the division is as follows:

Detail:
Brother: 1×2 = 2
Daughter: 1×1 = 1

Total: 3 Shares
