Is zakat applicable separately on the current value of shares?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Q1) Is zakat applicable seperately on current value of shares or it can be adjusted with other applicable assets/liabilities? For e.g zakat on gold has to be given no matter how much one owes to someone. Q2) While leading a congregational prayer, if imam doubts that his wudu due to some reason has nullified, then what should he do during prayer? If he continues, and after salah he founds that actually it was broken then what should a non -regular imam of a prayer area do; as he can not notify to the muqlids that the prayer has to be reperformed?

Answer

(Fatwa: 1516/1220/L=1430)

(1) There is no Zakah separately on the existing value of the shares, rather it will be counted with other assets and wealth owned by you and then Zakah will be calculated. The ruling you mentioned about the Zakah of gold is not right. If someone has gold but is in debt more than the value of the gold, there is no Zakah on him.

(2) If the wudhu is nullified during salah, the imam should appoint anyone as imam on his behalf by making signs. If he did not do so and performed the complete salah, he should inform the muqtadis about the same whether phone or by letter. If it is not possible in any way, it is compulsion:

کما یلزم الإمام إخبار القوم إذا أمھم وھو محدث أو جنب أو فاقد شرط أو رکن ۔۔۔ بالقدر الممکن بلسانہ أو بکتاب أو رسول علی الأصح لو معینین وإلا لا یلزمہ (الدر المختار مع الشامی 2:340)
