What should the husband do to reconcile with his wife according to Allah’s teachings?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
One of my friends daughter in law has refused to co-habitate with her husband. she also is visibly unhappy with the marriage which apparently took place due to the insistence of the parents of the girl. she has now sent a’ sms’ to her husband that he should not touch her as she does not like him. what is correct in the eyes of Allah that the boy does now. I am reminded of a Hadith that I had read as a sighting where in it was mentioned that the Propher (SAW) did a nikah with a lady who was given to him as Mal-e-ghaneemat. When the Prophet approached her she declined to co-habitate with him and said that she is not interested to continuing the marriage. The Prophet (SAW) immediately without hesitation set her free and divorced her. Please be kind to let me know the exact incident and the actual hadees and where can I find it in the Saheeh Bukhari.

Answer

(Fatwa: 1094/1094/M=1432)

(1) It is wrong if your friend’s bhabi does not want to live with her husband without any valid excuse. She is guilty. It is a sin to demand talaq without any valid reason. If the woman is not ready to live with her husband in any case and all the attempts of mutual understandings have gone in vain, then the husband should give only one talaq and make her free and should not keep her suspended.
(2) There are two different incidents. The woman that came as war spoil was Hadhrat Safiya (رضى الله عنها) who came in the share of a companion (رضى الله عنه) and he gifted her to the holy Prophet Muhammad (صلى الله عليه وسلم) and later the holy Prophet Muhammad (صلى الله عليه وسلم) set her free and married her and never divorced her. This is narrated in Sahih Bukhari. And the woman whom he married and divorced immediately after union it was Umaima bint Noman, as mentioned in Al-Bidayah O al-Nihaya, Vol. 5, p. 297.
