Can we hire out a Masjid?

Could you kindly inform us if it is permissible to hire out a Masjid (upper floor of the proper Masjid)? The hiring of the Masjid will cater for events such as Nikah and wedding functions. With due respect, could the answer please be supported with some evidence as this has become a major issue here in the UK and the US. At the same time could we please have the answer on a formal letter head?

(Fatwa: 408/414/N=1433)

It is not lawful to rent out the upper floor or any other floor or any part of a Shariah mosque for the ceremony of nikah or for any other work. Shariah mosque is sacred from ground to the sky. It is not lawful to do anything against the etiquette of the mosque except of Salah and other religious affairs. Also it is not lawful to make it a source of income.
قال فى الدر (مع الرد كتاب الوقف 6 :548 ط زكريا ديوبند) : ولا يجوز أخذ الأجرة منه ولا أن يجعل شيئا منه مستغلا ولا سكنى بزازيه اهـ المسجد إلى نفقة تؤجر قطعة منه بقدر ما ينقف عليه بأنه غير صحيح …. اهـ وقال الطحطاوي في حاشيته على الدر (كتاب الوقف 2:537) : قوله : “مستغلا” : ولو ليصرف على المسجد وإن احتاج ذلك ، ……….. ومن قال بتسويغ بعض المسجد فهو غير صحيح أفاده صاحب البحر اهـ
