Who inherits what when a couple splits up?

My family includes father mother and two sisters and myself (I am small and only brother). So how will be the father’s property be divided upon us mention the process and my mother also has a property so what are the rules for a mother to divide her property among her children (we three one brother and two sisters).

(Fatwa: 988/909/M=8/1439)

If your father is still alive then he is sole owner of his property during his lifetime. Now you (children) neither have any shares in his property nor you have any right to demand it by force. Yes, if the parents want to distribute their property among their children happily then they may do so as they are authorized to do so. And the best method to distribute one’s property during one’s lifetime is that all the children whether son or daughter are given equal shares, while the father and mother should hold back some shares with them for their subsistence.
