Is Indian business tax considered zakah?

I am a businessman and I am a taxpayer of Indian government. Then my tax should be count as zakah or not? If not, then what is the figure of my income to pay zakah? (means income-tax=net income, or income=net income. please help me.

(Fatwa: 250/209/N=3/1439)

(1) Both income tax and zakah are two separate things. Tax is paid to government and it is spent to administer the government affairs. Whereas zakah is an important Islamic duty and worship and it is only spent on such poor and needy Muslims other than Sayyid family. Also zakah is given into complete possession of an eligible person. Thus the tax which you pay to the government you cannot count in zakah.

هي – الزكاة – تمليك جزء مال عينه الشارع من مسلم فقير غير هاشمي ولا مولاه مع قطع المنفعة عن المملك من كل وجه لله تعالى (تنوير الأبصار مع الدر والرد ، اول كتاب الزكوة، 3: 180-183، ط مكتبة زكريا ديوبند)، قال الله تعالى: إنما الصدقت للفقراء والمساكين الآية (سورة التوبة: 60)، ولا إلى غني يملك قدر نصاب فارغ عن حاجته الأصلية من اي مال كان الخ، ……… ولا إلى بنى هاشم الخ (الدر المختار مع رد المحتار، كتاب الزكاة، باب المصرف، 3: 259-299)، قوله: “نحو مسجد”: كبناء القناطر والسقايات وإصلاح الطرقات وكري الأنهار والحج والجهاد وكل ما لا تمليك فيه. زيلعي (رد المحتار)، ومثله في مجمع الأنهر (كتاب الزكاة، 1: 227-228، ط: دار الكتب العلمية، بيروت)، حيث قال: ولا تدفع الزكوة لبناء مسجد؛ لأن التمليك شرط فيها ولم يوجد، وكذا بناء القناطير وإصلاح الطرقات وكري الأهار والحج وكل مالا تمليك فيه اهـ

 

(2) According to lunar calendar, the date on which the year of your zakah completes, you should pay fortieth part as zakah on the zakatable assets and wealth which you own. In future, the amount which is paid in any tax or is spent in any need it shall not be deducted from the zakah money. However, according to preferable opinion, on the completion of the year, fortieth part will be paid as zakah on all the zakatable assets and wealth.

وحولها قمري لا شمسي (تنوير الأبصار مع الدر والرد، كتاب الزكاة، قبيل باب زكاة المال، 3: 223، ط: مكتبة زكريا ديوبند)، فى البحر: فى المعراج في فصل زكاة العروض أن الزكاة تجب فى النقد كيفما أمسكه للنماء أو للنفقة، وكذا فى البدائع في بحث النماء التقديري اهـ، قلت: وأقره فى النهر والشرنبلالية وشرح المقدسي وسيصرح به الشارح أيضاً ونحوه قوله فى السراج: سواء أمسكه للتجارة أو غيرها، وكذا قوله فى التاترخانية: نوى التجارة أولا؟ (ردالمحتار، أول كتاب الزكاة، 3: 178-179).
