Masbuq, leading the remaining rakat of his salah as an Imam

I stay in Qatar. We sometimes see here in the mosques that a person joined the jamat (of any obligatory salah) in last rakahs and then after Imam finishes the salah he stands up, he is masbuq now some people again start a jamat behind him, making him Imam. According to Hanafi Fiqh, a masbuq (who missed some rak’ah with imam) cannot become imam. Hence it is not correct for a Hanafi to pray behind a masbuq imam, in this case the salah of muqtadi will not be valid. According to Hanafi Fiqh, the second jamah in locality mosque is makrooh; thus no other jamah should be established.

 وهو – أي: المسبوق – منفرد …… فيما يقضيه ……. إلا في أربع فكمقتد؛ أحدها لا يجوز الاقتداء به الخ (الدر المختار مع رد المحتار ، كتاب الصلاة ، باب الإمامة ، 2: 346-347 ط: مكتبة زكريا ديوبند)، ويكره تكرار الجماعة بأذان وإقامة في مسجد محلة لا في مسجد طريق الخ (المصدر السابق، ص 288)، قوله: “ويكره” أي : تحريماً لقول الكافي: لا يجوز، والمجمع: لا يباح ، وشرح الجامع الصغير: إنه بدعة كما في رسالة السندي (رد المحتار).
