How should the late father’s property be divided among siblings and mother?

I have 1 sister (married) and 3 brothers. All living separate now. And mother staying with me. Father has passed away. We want to distribute property of our father. How much percent of property cost to give to each of we brothers, sister and mother?

(Fatwa: 216/206/B=3/1438)

According to Shariah, in the above mentioned case all the property of your deceased father shall be divided into 72 shares. Out of the total, one eights part i.e. 9 shares shall go to your mother and 14-14 shares shall go to each brother, while the sister shall get 7 shares. The Shariah division of the property is as follows:

Details:

Wife:                1×09 = 09

Sons:                4×14 = 56

Daughter:          1×07 = 07

Total:                           72 Shares

Note: If your father did not leave his father or mother, rather he left only one wife, four sons and one daughter, then the above mentioned division is correct.
