Can widow stay at in-laws’ after 4 months & 10 days, with brother-in-law present?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
A woman, whose husband passed away a month ago, is currently sitting in ‘IDDAH’ in her in-laws house (where she stayed with her 3 children while her husband was still alive), after four months and 10 days, she becomes a stranger (non-mahram) to her father-in-law.
Her brother in-law also stays in the same house, please advise us on what to do after 4 months and 10 days, is she still allowed to stay there?

بسم الله الرحمن الرحيم

(Fatwa: 449/360/B=03/1435)

The said woman shall not turn non-mahram for her father-in-law after four months and ten days rather the daughter-in-law is haram forever for her father-in-law as per the Shariah. Hence after four months and ten days if the house is owned by the father-in-law and he wishes that his daughter-in-law should stay with him with his grandchildren and Shariah purdah is observed and there is no fear of fitnah then she may live with her father-in-law. She shall observe Shariah purdah with brother-in-law as he is non-mahram for her. And if there is no arrangement of Shariah purdah in the house then she should go to her parents’ home after passing iddah.
