Hajj-e-Badal in Hadith and Quran? What if someone dies before performing it?

My question is about the Hajj-e-Badal. First of all I would like to know that are the references of hajj-e-badal mentioned in the hadith and holy Quran.
Second if a Muslim has intention to perform his hajj but present conditions are not allowing and waiting to go in future and he expires all of sudden through brain hemorrhage or heart attack and previously could not make any wasiat of Hajj-e-Badal. Then in this condition what should the keens of marhum require to do?

(Fatwa: 436/B-87/TB=03/1435)

(1) It is not mentioned regarding Hajj-e-Badal in the holy Quran clearly. However, it is mentioned in Hadith. Two hadiths are narrated in Mishkat:
(1) عن ابن عباس رضي الله عنهما قال : ان إمراة من خثعم قالت يا رسول الله أن فريضة الله على عباده في الحج ادركت أبي شيخاً كبيراً لا يثبت على الراحلة أفأحج عنه قال نعم وذلك في حجة الوداع (متفق عليه)

(2) وعنه قال: أتى رجل النبي صلى الله عليه سلم فقال إن أختي نذرت أن تحج وأنهما ماتت فقال النبي صلي الله عليه وسلم: لو كان عليها دين أكنت قاضيه قال نعم قال فاقض دين الله أحق بالقضاء (متفق عليه) مشكوة المصابيح ص 221)
(2) When he could not perform hajj due to any Shariah excuse in time and he had to wait for sometime during which he died due to heart attach all of sudden and he could not make a will for Hajj-e-Badal, then in such case it is not wajib on the heirs of the deceased person to send someone for Hajj-e-Badal on his behalf rather all the property shall be divided among all his legal heirs. After the division if some heir sends someone for Hajj-e-Badal or if all the heirs are adult and after division all of them collect some money and send someone for Hajj-e-Badal, then it is hoped that Allah shall accept the hajj. It is mentioned in Fatwa Hindiyah:
من عليه الحج إذا مات قبل ادائه فإن مات عن غير وصية يأثم بلا خلاف وإن أحب الوارث أن يحج عنه حج وارجوا أن يجزئه ذلك إن شاء الله تعالي ، كذا ذكر ابو حنيفة رحمة الله تعالى (الفتاوى الهندية ج 1 ص 323 مكتبه اتحاد ديوبند)
