Register with Waqf Board to donate land to Markaz?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
We are going to donate our land to Markaz (Mosque & Madrasa). Could you please explain the process? Is it necessary to register in Waqf Board? What is the role and activities of Mutawalli and committee and how to form the committee?

بسم الله الرحمن الرحيم

(Fatwa: 1292/1292/M=11/1434)

As much land you want to donate (endow) to the madrasa or masjid, you should specify that portion and simply say that you have endowed this land for so and so madrasa or masjid. Just by saying this, the land shall become endowed and go out of your possession. It is not necessary to register it in Waqf Board. But if you fear of embezzlement and getting it registered guarantees its safety then it is better. It is the responsibility of the mutawalli (custodian or keeper) or concerning committee that they safeguard the waqf and use it in the same head for which it had been endowed. They should not use it in a place where the waqf is lost or it violates the intention of the endower.
You should explain why you want to form the committee and how you will do that, then we can have a say about it.
