LIC Interest

Answered according to Hanafi Fiqh by
(1) My Uncle (Mamu) has died before 1 year back. He is having one girl and boy. His son is studying in B. Pharmacy and having fees 72,000 per year. They have deposited 2 lack Rupees in LIC before 8 years. They got 4 lakhs. So my uncle’s son is using this whole amount for study. They do not have any source to spend for study. Is this amount halal for him for study purpose?
(2) I am going to marry with my uncle’s daughter because she is yateem. Can I marry with her because they are using LIC interest amount. Please tell me I am confused.

(Fatwa: 1087/844/H=9/1434)

(1) The amount deposited in LIC became inheritance of your uncle which should properly be distributed among the heirs, only the son is not eligible to use that money. While the extra money received or to be received on LIC should be distributed to the poor and needy ones without an intention of reward rather with an intention to get rid of the malicious money. It is unlawful for the heirs to use the extra money.

(2) You can marry the daughter of your uncle. But you should keep on trying to rectify the heirs of the uncle to possible extent.
