Answered as per Hanafi Fiqh by Darulifta-Deoband.com
What is the ratio of distribution of property as per Islamic Shariah my father died on 02/01/1995 my mother died on 30/09/1983 we are 3 brothers and 5 sisters from my father’s first marriage after our mother died my father got second marriage and from second marriage he had one daughter, at the time of my father death we were 3 brothers 5 sisters and my father second wife and her daughter were alive. My father has left some properties which we want to sell and share the amount among us, how should it be distributed between 3 brothers 5 sister and my father’s second wife and her daughter what is the ratio in Islam?

بسم الله الرحمن الرحيم

(Fatwa: 870/870/M=1434)

In the above mentioned case the whole property of your father shall be divided into 96 shares. Out of which 12 shares shall go to your step mother (the second wife of your father) and 7 shares to her daughter while 14-14 shares to each brother and 7-7 shares to each sister. The detail of division is as follows:

Details:
Wife: 1×12 = 12
Sons: 3×14 = 42
Daughters: 6×07 = 42
Total: 96
