Can you provide with dalīls on not to respond to salām by gesture in salāh?

Dear and honored Maulana Sahib, Hoping and praying that you along with your family are very well in shaa Allah, I would like to ask you something about giving salaam to the person who is making his salaah, i.e., some salafi brothers when entering a masjid they give salaam and the jamaat is praying fard salaah, and some other salafis, who are praying also, take their salaam with moving their hands. So, I know that this is makrooh according to our hanafi madhhab, but could you please elaborate this issue more explicitly with daleels, in order to have arguments against their (salafi’s) action in giving and taking salaam being praying salaah.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

There are two issues in your query:

  1. Extending salām to people performing salāh;
  2. Responding, whether verbally or by gesture, to salām while in salāh.

Both of these should be avoided[1].

Consider the following narration:

Abdullah (may Allah be pleased with him), the companion of Prophet Muhammad (peace and salutations be upon him), narrates:

كنا نسلم على النبي ‏ ‏صلى الله عليه وسلم ‏ ‏وهو في الصلاة فيرد علينا فلما رجعنا من عند ‏ ‏النجاشي ‏ ‏سلمنا عليه فلم يرد علينا وقال ‏ ‏إن في الصلاة شغلا ‏

Translation: We [the companions] would greet Allah`s Messenger (peace be upon him) while he would be in salāh and he would respond to us. However, when we returned from being with An-Najashi [in Abyssinia], we extended our salām and he did not respond to us. And He (peace be upon him) said, “[I do not respond to greetings in salāh since] Verily, in salāh, one is occupied [with its own rituals and recitals.].” [Sahīh al-Bukhārī]

It is clear from the above that offering salām to a person performing salāh and responding to a salām is abrogated (mansūkh). It is not permissible to practise on something that is abrogated[2].

(قوله لا بيده) أي لا يفسدها رد السلام بيده، خلافا لمن عزا إلى أبي حنيفة أنه مفسد فإنه لم يعرف نقله من أحد من أهل المذهب، وإنما يذكرون عدم الفساد بلا حكاية خلاف، بل صريح كلام الطحاوي أنه قول أئمتنا الثلاثة، وكأن هذا القائل فهم من قولهم ولا يرد بالإشارة أنه مفسد كذا في الحلية لابن أمير الحاج الحلبي، واستدرك في البحر على قوله فإنه لم يعرف إلخ بأنه نقله صاحب المجمع وهو من أهل المذهب المتأخرين، ومع هذا فالحق أن الفساد ليس بثابت في المذهب؛ وإنما استنبطه بعض المشايخ مما في الظهيرية وغيرها من أنه لو صافح بنية التسليم فسدت فقال: فعلى هذا تفسد أيضا إذا رد بالإشارة، ويدل لعدم الفساد أنه – عليه الصلاة والسلام – فعله كما رواه أبو داود وصححه في الترمذي.

وصرح في المنية بأنه مكروه: أي تنزيها، وفعله – عليه الصلاة والسلام – لتعليم الجواز فلا يوصف فعله بالكراهة كما حققه في الحلية. اهـ.

[2] وبعد هذا يحتاج إلى بيان محل الاجتهاد، قال ابن سماعة عن محمد رحمهما الله: كل أمر جاء عن النبي صلى الله عليه وسلم أنه فعله، وجاء عنه غير ذلك الفعل، أو جاء عن أحد من أصحاب النبي صلى الله عليه وسلم، وجاء عن ذلك الرجل، أو غيره من الصحابة بخلافه وعمل في الناس بأحد الأمرين دون الآخر، أو عمل بأحد القولين، ولم يعمل بالأخر، ولم يحكم به أحد، فهو متروك منسوخ، فإن حكم به حاكم من أهل زماننا لم يجز، أشار إلى أنه وإن قضى بالنص لكن ثبت بإجماع الأمة انتساخه، حيث لم يعمل به أحد من الأمة، والعمل بالمنسوخ باطل غير جائز.
