Is it permissible to pray tahajjud salaah when one is awake till late at night or is it necessary to sleep and then wake up to pray tahajjud?

Answered as per Hanafi Fiqh by Askmufti.co.za

Q: Is it permissible to pray tahajjud salaah when one is awake till late at night or is it necessary to sleep and then wake up to pray tahajjud?

A. Although there is more reward for Tahajjud if one wakes up from sleep and then performs it, (because of the sacrifice of parting from a warm bed), Tahajjud is valid from after Eshaa Salaah. Nafl performed after Eshaa Salaah will be counted as Tahajjud. (Al Bahrur Raa’iq V4 P245)
