Non Baaligh Boy as Mahram for Hajj

Answered as per Hanafi Fiqh by Askmufti.co.za
Q: I am a single divorced mother of a 10 year old son. He isn’t baaligh as yet. I am by the means to go for umrah/hajj. I don’t have any brothers, uncles or a father and grandfather. Is it permissible to go for hajj/umrah with my son as mahram even though he isn’t baaligh yet?

A. A boy who is not Baaligh cannot serve as a Mahram on journey. (Fataawa Al Hindiyyah V1 P219). One of the conditions of Haj becoming Fardh on a female is a Mahram. If you do not have another Mahram available, Haj will not be Fardh on you. If no one else is available, you will have to wait until he becomes Baaligh.
