Answered as per Hanafi Fiqh by Askimam.org

with reference of your Fatwa # 31384,

i have seached for fatwa deuband and attached with it.

please review the question, as a tiens company member one must have to bring his fellowers to upgrade his stars.

i think that people joining the said company have to bring other people in streamline to earn money for there own(it is based on greed ) ,

but on the other hand

tiens company said yes you have to do this exactly , not on the basis of greed but on the basis of concept that

“you should help the poor people to join us and earn incom to become rich”.

kindly review the fatwa.

We had reviewed that fatwa of Darululoom Deoband a while back and responded to a similar query which was a follow-up on Fatwa # 31384, but answered via the Darul Iftaa website. [1]

Apparently the Tiens multilevel marketing schemes may seem to be Shariah compliant according to your explanation. However, it will be irresponsible for us to issue a ruling for or against the scheme without reviewing their contract as there could be clauses in the contract that could be non-Shariah compliant. In order for us to issue a ruling, you may forward the contract to the following email address admin@daruliftaa.net.

[1]Question:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In relation with the fatwa i asked about Tiens Company

http://askimam.org/public/question_detail/31384

BAKAR would get a fixed amount of commission/money whenever his referenced members buy further products.

And as his referenced members number increases , he will hence get more commissions.

And if now Bakar dont buy anything , he will still get this fixed amount of commission ,

as his registered members buy products.

So now BAKAR will get money , whenever his registered members buy things.

The darul uloom deoband fatwa is attached herewith.See it

In order for us to issue a ruling on the multilevel scheme in reference, you may forward the contract of the company in reference as there is a possibility that apart from the structure that you have explained there could be other clauses that are non-Shariah compliant.
