Taxation

Answered as per Hanafi Fiqh by Askimam.org

I live in New York. Every year we need to file the taxes with the goverment and state. At the time of filing the taxes both the goverment and state allows a person to show certain expenses in their taxes after which they calculate and send money back to a person which they have already deduct automatically from a person monthly salary paycheck.

My Question is that is it allowed to show false expenses in your taxes in order to receive the refund from the goverment and state (please note that the money the refund cannot exceed the money they have deducted from the person paycheck; for example if the goverment dedcuts $3,000 from a monthly salary then the maximum refund they can give is only $2,200 if we show false expenes). Every year I pay Zakat and Sadaqa ALHAMDU LILLAH.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

We have repeatedly advised our muslim brothers living as minorities in non-Muslim countries like United States, Britain, Australia etc. to abide by the laws of their countries which are not in conflict with Sharī‘ah.

It is not permissible to lie or deceive in order to pay less tax. If you feel the taxes are high, consult a tax consultant who may advise you to use the law in your favour to reduce the taxes.[1]
