Jumu’ah before Zawal

I have attached an article written and forwarded by our masjid regarding the jumuah salah before zawal and as mentioned in the article they state that eminent sahabah ra did pray before zawal. 

I will appreciate if you can explain this with references.

Bismillah-e-Ar-Rahman-e-Ar-Rahim,

The question of Juma’ah salat before zawal is something that some communities in

the USA and around the world are finding itself confronted with due to different

issues such as space for salat and parking space. We faced the same here at MCMC

as we had two juma’ah where the first juma’ah startied @ 12:15 PM and the second

@ 1:15 PM and both were after zawal. When the Day Light Saving came into effect

where the Juma’ah schedule of first salat starting @ 12:15 PM and second salat

starting @ 1:15 PM were no longer after zawal and hence the decision has to be

made to either keep the same schedule or shift the timings. The decision that was

adopted was to keep the schedule.

This decision was made based on the fact that

there is validity in ahle sunat wa aljamat for juma’ah before zawal specially if there

is practical reasons to accommodate musaleen. The decision did not bring any

difficulty on the community as those who preferred to pray after zawal had that

opportunity- they could join the second salat. This schedule divided the musaleen

into better split between the two salats.

Even though, we find that the majority of scholars are of the opinion that the time

of Jumu`ah begins only after zawal (that is, the time of Zuhr), we find no explicit

statement to that effect from Rasullaullah (s.a.a.w.s). On the other hand there are

such statements concerning the timings of other prescribed salawat. This is perhaps

the reason that the differences of opinion among the sahabah r.a. and later

scholars in regards to the permissibly of praying Jumu`ah before zawal. This

is supported by a hadith reported on the authority of Salamah ibn Al-

Akwa` (may Allah be pleased with him) that he said, “We used to pray

Jumu`ah (during Rasulullah’s s.a.a.w.s. time), and then while walking home we

could hardly see any shade from the walls protecting us from the sun’s heat” (sahih

Al-Bukhari and sahih Muslim). Another relevant hadith on the subject is on the

authority of Jabir ibn ‘Abdullah r.a (sahih Muslim, #1427.) Therefore, based

on these and similar others reports in the sources, Imam Ahmad r.a and Ishaq

ibn Rahawayhi r.a. are of the opinion that Jumu`ah can be performed

before zawal; even some of the Hanabela have gone as far as saying that

the time of Jumu`ah is the time of the `Eid prayers.

We also see that Imam Malik r.a, take a middle approach and his opinion is between the two

extreme views and states that while the khutbah can be given before the

time of zawal, salah itself should take place only after zawal.

In addition to sahaba reporting from Rasullaullah s.a.aw.s, we also find that from

the earlier source that seem to indicate that there had been some latitude in the

time of Jumu`ah in the early years and that praying Jumu`ah after zawal was not

always considered the accepted norm. In support of this opinion, `Abdullah ibn

Shayban r.a. reports, “I prayed Jumu`ah behind Abu Bakr; his

entire khutbah and salah finished before midday.

He report that I attended the same under `Umar, and his khutbah and salah lasted until I could say that it was almost midday. He further reported that I attended Jumu`ah

under `Uthman and his khutbah and salah lasted until I could say that the

sun had actually declined, and yet no one had ever found fault with the

action of anyone of them”. This report seems to support the view that

Jumu`ah can be performed before zawal. More evidence to further

strengthened these reports about the sahabat-ul-Rasullallah s.aa.w.s such

prominent on such as Ibn Mas`ud r.a (who’s opinions has a very

strong influence on Hanafih school of jurisprudence), Jabir, Sa`id r.a. , and

even Mu`awiyah, stating that they all prayed Jumu`ah before zawal. There

are also narrations regarding juma’ah aling on the day of ‘Eid

and permissibly there.

When pondered upon above, it is not hard to conclude that there is nothing wrong

in praying Jumu`ah before Zuhr time, particularly when musaleen and masjid

administration are under pressure to do so because of circumstances they have not

full control.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The issue of performing Jumu‘ah before zawāl (mid-day) is definitely one of great importance, especially in the West. This issue has gained more prominence due to the nature of Jumu‘ah being a community-based responsibility. The word jumu‘ah intrinsically holds the meaning of congregating. Furthermore, the very philosophy of Jumu‘ah is to gather the Muslims of a community as a display of unity and number. Certain restrictions and constraints due to lack of space, time, etc. has also played its role in pushing the issue towards permissibility in certain areas.

On the other hand, Jumu‘ah being a form of ‘ibādah restricts the “laxity” in determining its time. The reason being, ‘ibādāt (acts of worship) are tawqīfī. Meaning, the method, conditions, and other details of salah are based on explicit commands. This is especially true in the case of the time for obligatory prayers. Hence, many communities have taken a more cautious approach and have looked for other alternatives.

The view of the permissibility of performing Jumu‘ah before mid-day (qabl al zawāl) is based on the Hanbalī school of fiqh.[1] Even according to the Hanbalī school, it is preferable to perform after mid-day. The famous Hanbalī jurist, Ibn Qudamah Al Hanbalī mentions in Al Mughnī:

الأولى أن لا تصلى إلا بعد الزوال (المغني، كتاب صلاة الجمعة)

It is preferable for it (Jumu‘ah) to be performed after mid-day (Al Mughni vol.3 pg.84, Dar Al Hadith)

However, the majority of scholars do not allow Jumu‘ah to be performed before mid-day. This is confirmed by Ibn Qudamah Al Hanbali himself in Al Mughnī:

وقال أكثر أهل العلم: وقتها الظهر إلا أنه يستحب تعجيلها في أول وقتها (المغني، كتاب الجمعة)

Majority of the scholars have said: Its (Jumu‘ah) time is the same as the time of Zuhr. However, it is preferable to perform it in its earliest time (Al Mughni vol.3 pg.82, Dar Al Hadith)

In light of the above, it is incorrect to condemn those following the Hanbalī school for performing Jumu‘ah before mid-day. Imam Ahmad bin Hanbal Rahimahullah was an illustrious mujtahid who based this view on his understanding of certain narrations. As such, a muqallid (follower) of the Hanbali school of thought may follow this opinion of Imam Ahmad bin Hambal Rahimahullah.

As far as the adherents of the Hanafī, Mālikī, and Shāfi‘ī schools are concerned, they may not perform jumu‘ah before mid-day. Imām Nawawī mentions in his commentary on Sahih Muslim:

وقد قال مالك وأبو حنيفة والشافعي وجماهير العلماء من الصحابة والتابعين فمن بعدهم لا تجوز الجمعة إلا بعد زوال الشمس ولم يخالف في هذا إلا أحمد بن حنبل وإسحاق فجوازها قبل الزوال (شرح النووي على مسلم، باب صلاة الجمعة حين تزول الشمس)

Verily Malik, Abu Hanifah, Shafi‘i, the majority of the Sahabah, Tabi‘een, and those after them have said that it is impermissible to perform Jumu‘ah except after mid-day. And no one has gone against this except Ahmad bin Hanbal and Ishaq. They say it is permissible before mid-day.

Accordingly, it is incorrect for the adherents of other schools of thought to condemn the Hambali school on this issue. Likewise, it is also incorrect for adherents of the Hambali school of thought to impose practicing on their view to adherents of other schools of thought. We respect the various schools and even facilitate for each other. 

An article substantiating the position of the Jumhūr (majority) and answering the counter-arguments can be found in the footnotes for the benefit of the ‘ulamā’.[2]

وذهب الحنابلة إلى أن أول وقت صلاة الجمعة هو أول وقت صلاة العيد (الموسوعة الفقهية الكويتية ج-٢٧ ص-١٩٧)

بحث الجمعة قبل الزوال

بسم الله الرحمن الرحيم

موضوع البحث أن الجمعة هل تؤدى قبل الزوال أم لا. فجمهور العلماء ذهبوا إلى أنها لا تؤدى قبل الزوال وقد خالفهم في ذلك الإمام أحمد بن حنبل- وهو مكلف بما أدى إليه اجتهاده- وجوزها قبل الزوال. ففيما يلي نقوي مذهب الجمهور بنبذة من الدلائل الواضحة والأجوبة القاطعة التي أفادها –أو أكثرها- الإمام الحافظ ابن حجر في “فتح الباري” والعلامة المحقق ظفر أحمد التهانوي في “إعلاء السنن”

دلائل الجمهور

١). عن أنس بن مالك أن رسول الله صلى الله عليه وسلم كان يصلي الجمعة حين تميل الشمس رواه البخاري، باب وقت الجمعة إذا تزول الشمس

٢). عن سلمة بن الكوع قال كنا نجمع مع رسو الله صلى الله عليه وسلم إذا زالت الشمس ثم نرجع نتتبع الفيء رواه مسلم، باب صلاة الجمعة حين تزول الشمس

٣). حدثنا وكيع، عن أبي القيس عمرو بن مروان، عن أبيه، قال كنا نجمع مع علي، إذا زالت الشمس رواه ابن أبي شيبة، باب من كان يقول وقتها زوال الشمس وقت الظهر

٤). قدم معاذ مكة وهم يجمعون في الحجر فقال لا تجمعوا حتى تفيء الكعبة من وجهها رواه ابن أبي شيبة، باب من كان يقول وقتها زوال الشمس وقت الظهر

دلائل الحنابلة مع الأجوبة عنها

 

١). عن أنس بن مالك قال كنا نبكر بالجمعة ونقيل بعد الجمعة رواه البخاري، باب وقت الجمعة إذا زالت الشمس

الجواب: قال الحافظ في الفتح “ظاهره أنهم كانوا يصلون الجمعة باكر النهار لكن طريق الجمع أولى من دعوى التعارض وقد تقرر فيما تقدم أن التبكير يطلق على فعل الشيء في أول وقته أو تقديمه على غيره وهو المراد هنا والمعنى أنهم كانوا يبدئون بالصلاة قبل القيلولة بخلاف ما جرت به عادتهم في صلاة الظهر في الحر فإنهم كانوا يقيلون ثم يصلون لمشروعية الإبراد” 

٢). عن سهل قال ما كنا نقيل ولا نتغذى إلا بعد الجمعة رواه البخاري ومسلم، باب صلاة الجمعة حين تزول الشمس

الجواب: قال الحافظ في الفتح “وتعقب بأنه لا دلالة فيه على أنهم كانوا يصلون الجمعة قبل الزوال بل فيه أنهم كانوا يتشاغلون عن الغذاء والقائلة بالتهيؤ للجمعة ثم بالصلاة ثم ينصرفون فيتداركون ذلك. بل ادعى الزين بن المنير أنه يؤخذ منه أن الجمعة تكون بعد الزوال لأن العادة في القائلة أن تكون قبل الزوال فأخبر الصحابي أنهم كانوا يشتغلون للجمعة عن القائلة ويؤخرون القائلة حتى تكون بعد صلاة الجمعة”

٣). عن سلمة قال كنا نصلي مع رسول الله صلى الله عليه وسلم الجمعة ثم ننصرف وليس للحيطان فيء رواه أبو داود، باب في وقت الجمعة

الجواب: في رواية مسلم “وما نجد للحيطان فيئا نستظل به” قال العلامة ظفر أحمد (باب أن وقت الجمعة بعد الزوال) “إنما كان كذلك لأن الجدران كانت في ذلك العصر قصيرة لا يستظل بظلها إلا بعد توسط الوقت لا سيما في زمان تكون فيه الشمس على سمت الرأس ويطول النهار فلا دلالة في ذلك على أنهم كانوا يصلون قبل الزوال بل كانوا يصلون إذا زالت الشمس مع الخطبتين والقراءة والذكر الذي ذكرتموه وينصرفون عن الصلاة قبل توسط الوقت وليس للحيطان ظل يستظل به كذا في النيل أيضا (١٣٧:٣) يدل على ذلك ما رواه مسلم عن أياس بن سلمة عن أبيه أيضا قال: “كنا نجمع مع رسول الله صلى الله عليه وسلم إذا زالت الشمس ثم نرجع نتتبع الفيء” (٢٨٣:١) ففيه تصريح بأنهم كانوا يجمعون بعد الزوال ومع ذلك لا يجدون للحيطان فيئا يستظل به بعد انصرافهم عن الصلاة لقصر الحيطان والجدران قال النووي قوله “نتتبع الفيء” إنما كان ذلك لشدة التبكير وقصر حيطانه وفي تصريح بأنه كان قد صار فيء يسير وقوله “وما نجد فيئا نستظل به” موافق لهذا فإنه لم ينف الفيء من أصله وإنما نفى ما يستظل به وهذا مع قصر الحيطان ظاهر في أن الصلاة كانت بعد الزوال متصلة به اه (٢٨٣:١)”

٤). عن ابن السباق أن رسول الله صلى الله عليه وسلم قال في جمعة من الجمع يا معشر المسلمين إن هذا يوم جعله الله عيدا فاغتسلوا ومن كان عنده طيب فلا يضره أن يمس منه وعليكم بالسواك رواه مالك، باب ما جاء في السواك

الجواب: قال الحافظ في الفتح، باب وقت الجمعة إذا زالت الشمس “وتعقب بأنه لا يلزم من تسمية يوم الجمعة عيدا أن يشتمل على جميع أحكام العيد بدليل أن يوم العيد يحرم صومه مطلقا سواء صام قبله أو بعده بخلاف يوم الجمعة باتفاقهم”

وقال العلامة ظفر في إعلاء السنن “وأيض فالخطبة في العيد بعد الصلاة وتحب في الجمعة مقدمة عليها ويكره التنفل في العيد قبل الصلاة وبعدها في المصلى ولا كذلك الجمعة ولا يشرع النداء لصلاة العيد والجمعة بخلافها”

٥). عن عبد الله بن سيدان السلمي قال شهدت الجمعة مع أبي بكر الصديق فكانت خطبته وصلاته قبل نصف النهار ثم شهدنا مع عمر فكانت خطبته وصلاته إلى أن أقول تنصف النهار ثم شهدنا مع عثمان فكانت خطبته وصلاته إلى أن أقول زال النهار فما رأيت أحدا عاب ذلك ولا أنكره رواه ابن أبي شيبة، باب من كان يقيل بعد الجمعة ويقول هي أول النهار

الجواب: قال الحافظ في الفتح “رجاله ثقات إلا عبد الله بن سيدان وهو بكسر المهملة بعدها تحتانية ساكنة فإنه تابعي كبير إلا أنه غير معروف العدالة، قال ابن عدي شبه المجهول وقال البخاري لا يتابع على حديثه، بل عارضه ما هو أقوى منه فروي ابن أبي شيبة من طريق سويد بن غفلة أنه صلى مع أبي بكر وعمر حين زالت الشمس إسناده قوي وفي الموطأ عن مالك بن أبي عامر قال كنت أرى طنفسة لعقيل بن أبي طالب تطرح يوم الجمعة إلى جدار المسجد الغربي فإذا غشيها ظل الجدار خرج عمر إسناده صحيح وهو ظاهر في أن عمر كان يخرج بعد زوال الشمس وفهم منه بعضهم عكس ذلك ولا يتجه إلا إن حمل على أن الطنفسة كانت تفرش خارج المسجد وهو بعيد والذي يظهر أنها كانت تفرش له داخل المسجد وعلى هذا فكان عمر يتأخر بعد الزوال قليلا وفي حديث السقيفة عن بن عباس قال فلما كان يوم الجمعة وزالت الشمس خرج عمر فجلس على المنبر وأما على فروى بن أبي شيبة من طريق أبي إسحاق أنه صلى خلف على الجمعة بعد ما زالت الشمس إسناده صحيح وروي أيضا من طريق أبي رزين قال كنا نصلي مع علي الجمعة فأحيانا نجد فيئا وأحيانا لا نجد وهذا محمول على المبادرة عند الزوال أو التأخير قليلا وأما النعمان بن بشير فروى بن أبي شيبة بإسناد صحيح عن سماك بن حرب قال كان النعمان بن بشير يصلي بنا الجمعة بعد ما تزول الشمس قلت وكان النعمان أميرا على الكوفة في أول خلافة يزيد بن معاوية وأما عمرو بن حريث فأخرجه بن أبي شيبة أيضا من طريق الوليد بن العيزار قال ما رأيت إماما كان أحسن صلاة للجمعة من عمرو بن حريث فكان يصليها إذا زالت الشمس إسناده صحيح أيضا وكان عمرو ينوب عن زياد وعن ولده في الكوفة أيضا”

٦). عن عبد الله بن سلمة قال صلى بنا عبد الله الجمعة ضحى وقال خشيت عليكم الحر رواه ابن أبي شيبة، باب من كان يقيل بعد الجمعة ويقول هي أول النهار

الجواب: قال الحافظ في الفتح “وأما ما يعارض ذلك عن الصحابة فروى بن أبي شيبة من طريق عبد الله بن سلمة وهو بكسر اللام قال صلى بنا عبد الله يعني بن مسعود الجمعة ضحى وقال خشيت عليكم الحر وعبد الله صدوق إلا أنه ممن تغير لما كبر قاله شعبة وغيره”

٧). عن سعيد بن سويد قال صلى بنا معاوية الجمعة ضحى رواه ابن أبي شيبة، باب من كان يقيل بعد الجمعة ويقول هي أول النهار

الجواب: قال الحافظ في الفتح “ومن طريق سعيد بن سويد قال صلى بنا معاوية الجمعة ضحى وسعيد ذكره بن عدي في الضعفاء”
