Will this also be counted as gambling?

I go to my local supermarket for weekly shopping there is a competition if you spend over $20 you write you name at the back of the receipt will go into the draw to win $200. Will this also be counted as gambling are Muslims allowed to participate in this kind of competition.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Gambling is defined as a contract in which there is a possibility of gaining more or losing everything based on a future uncertain event. For example, if one says, ‘If it rains today you will have to give me a thousand Rand and if it does not rain then I will give you a thousand Rand. [1]

In the enquired situation one is not paying separately to enter the competition in which he risks losing his money. The store has merely permitted one to enter into a free competition after making purchases of $20 and nor does the competition entail any form of interest. [2]It is permissible to take part in such a competition.

 [1] (وحرم شرط الجعل من الجانبين لا من أحد الجانبين) لما روى ابن عمر – رضي الله عنهما – «أن النبي – صلى الله عليه وسلم – سبق بالخيل وراهن»، ومعنى شرط الجعل من الجانبين أن يقول إن سبق فرسك فلك علي كذا، وإن سبق فرسي، فلي عليك كذا وهو قمار فلا يجوز لأن القمار من القمر الذي يزاد تارة، وينقص أخرى، وسمي القمار قمارا لأن كل واحد من المقامرين ممن يجوز أن يذهب ماله إلى صاحبه، ويجوز أن يستفيد مال صاحبه فيجوز الازدياد والانتقاص في كل واحد منهما فصار قمارا (تبين الحقائق ج6 ص 227 امدادية)

فإن شرطوا الجعل من الجانبين فهو حرام وصورة ذلك: أن يقول الرجل لغيره: تعال حتى نتسابق، فإن سبق فرسك، أو قال: إبلك أو قال: سهمك أعطيك كذا، وإن سبق فرسي، أو قال: إبلي، أو قال: سهمي أعطني كذا، وهذا هو القمار بعينه؛ وهذا لأن القمار مشتق من القمر الذي يزداد وينقص، سمي القمار قماراً؛ لأن كل واحد من المقامرين ممن يجوز أن يذهب ماله إلى صاحبه، ويستفيد مال صاحبه، فيزداد مال كل واحد منهما مرة وينتقص أخرى، فإذا كان المال مشروطاً من الجانبين كان قماراً، والقمار حرام، ولأن فيه تعليق تمليك المال بالخطر، وإنه لا يجوز.(المحيط البرهاني ج8 ص14 ادارة القران)
