Is the time between MISL E AWWAL & MISL E SANI is for both zuhur aur asar prayers ?

Is time between SHAFAQ E ABYAZ & SHAFAQ E AHMAR is for both maghrib and esha prayers ?

The saying of Imam Abu Hanifa of that zuhur time is uptill misl e sani is not ZHIR RAWAYA

because it is not in 6 books of Imam Muhammad.

These are views of Imam Kashmiri and endorsed by Mufti Taqi Usmani .

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1) While the time between Al Mithl Al Awwal and Al Mithl As Thani is considered as Waqt Mushtarak (time for both Zuhr and Asr) in the individual opinion of some Ulama[1], as a follower of the Hanafi Mabhab, we are obliged to follow the most preferred view in the Mabhab. 

According to Imam Abu Hanifa Rahimahullah and the Mufta Bihi (most preferred view) in the Hanafi Madhab, the time for Zuhr Salaah is from Zawaal (i.e. when the sun starts declining towards the west) until Al Mithl As Thani, (i.e. when the length of the shadow of an object has reached twice the length of the object plus Fay-e-Zawaal. If, for example, the length of the shadow of a meter stick at Zawaal is 10 centimetres, then Zuhr time will finish and Asr time will begin when the length of the shadow is two metres and 10 centimetres).[2]

The time of Asr Salaah begins from Al Mithl As Thani till sunset. Hence, the time between Al Mithl Al Awwal and Al Mithl As Thani is only for Zuhr Salaah.[3] This is also the view of Mufti Taqi Usmani in Inam ul Bari.

2) The time of Maghrib Salah is from after sunset until Ash Shafaq Al Ahmar (redness in the sky or the Nautical twilight). The time between Ash Shafaq Al Abyadh and Ash Shafaq Al Ahmar is only for Maghrib Salaah.[4]

3) Pertaining to the timings of Zuhr in Zaahir ur Riwayah, is mentioned in Al Asl of Imam Muhammad, narrated from Imam Abu Hanifa Rahimahullah ;

قلت أَرَأَيْت وَقت الظّهْر مَتى هُوَ قَالَ من حِين تَزُول الشَّمْس إِلَى أَن يكون الظل قامة فِي قَول أبي يُوسُف وَمُحَمّد وَقَالَ أَبُو حنيفَة لَا يدْخل وَقت الْعَصْر حَتَّى يصير الظل قامتين فَإِذا صَار الظَّن قامتين دخل وَقت  الأصل المعروف بالمبسوط للشيباني (1/ 144)العصر

‘Imam Abu Hanifa says that the time of Asr does not enter until the shadow becomes double (Al Mithl As Thani).’

Even though the ending time of Zuhr is not mentioned specifically in Zaahir ur Riwayah, it is mentioned in a Hadith narrated by Imam Abu Hanifa Rahimahullah that Zuhr ends when Asr time enters. The details of this has been mentioned in the footnote for the reference of Ulama.[5]

ولكن علمت أن أكثر المشايخ على اشتراط بلوغ الظل مثليه والأخذ به أحوط لبراءة الذمة بيقين إذ تقديم الصلاة عن وقتها لا يصح وتصح إذا خرج وقتها فكيف والوقت باق اتفاقا وفي رواية أسد إذا خرج وقت الظهر بصيرورة الظل مثله لا يدخل وقت العصر حتى يصير ظل كل شيء مثليه فبينهما وقت مهمل فالاحتياط أن يصلى الظهر قبل أن يصير الظل مثله والعصر بعد مثليه ليكون مؤديا بالاتفاق كذا في المبسوط “و” أول “وقت العصر من ابتداء الزيادة على المثل أو المثلين” لما قدمناه من الخلاف

 “و” أول وقت “المغرب منه” أي غروب الشمس “إلى” قبيل “غروب الشفق الأحمر على المفتى به” وهو رواية عن الإمام وعليها الفتوى وبها قالا

وَأَمَّا آخِرُهُ فَلَمْ يُذْكَرْ فِي ظَاهِرِ الرِّوَايَةِ نَصًّا، وَاخْتَلَفَتْ الرِّوَايَةُ عَنْ أَبِي حَنِيفَةَ، رَوَى مُحَمَّدٌ عَنْهُ إذَا صَارَ ظِلُّ كُلِّ شَيْءٍ مِثْلَهُ سِوَى فَيْءِ الزَّوَالِ، وَالْمَذْكُورُ فِي الْأَصْلِ وَلَا يَدْخُلُ وَقْتُ الْعَصْرِ حَتَّى يَصِيرَ الظِّلُّ قَامَتَيْنِ وَلَمْ يَتَعَرَّضْ لِآخِرِ وَقْتِ الظُّهْرِ، وَرَوَى الْحَسَنُ عَنْ أَبِي حَنِيفَةَ أَنَّ آخِرَ وَقْتِهَا إذَا صَارَ ظِلُّ كُلِّ شَيْءٍ مِثْلَهُ سِوَى فَيْءِ الزَّوَالِ، وَهُوَ قَوْلُ أَبِي يُوسُفَ وَمُحَمَّدٍ وَزُفَرَ وَالْحَسَنِ وَالشَّافِعِيِّ، وَرَوَى أَسَدُ بْنُ عَمْرٍو وَعَنْهُ إذَا صَارَ ظِلُّ كُلِّ شَيْءٍ مِثْلَهُ سِوَى فَيْءِ الزَّوَالِ خَرَجَ وَقْتُ الظُّهْرِ، وَلَا يَدْخُلُ وَقْتُ الْعَصْرِ مَا لَمْ يَصِرْ ظِلُّ كُلِّ شَيْءٍ مِثْلَيْهِ، فَعَلَى هَذِهِ الرِّوَايَةِ يَكُونُ بَيْنَ وَقْتِ الظُّهْرِ وَالْعَصْرِ وَقْتٌ مُهْمَلٌ كَمَا بَيْنَ الْفَجْرِ وَالظُّهْرِ، وَالصَّحِيحُ رِوَايَةُ مُحَمَّدٍ عَنْهُ، فَإِنَّهُ رُوِيَ فِي خَبَرِ أَبِي هُرَيْرَةَ، وَآخِرُ وَقْتِ الظُّهْرِ حِينَ يَدْخُلُ وَقْتُ الْعَصْرِ وَهَذَا يَنْفِي الْوَقْتَ الْمُهْمَلَ
