Who do the children belong to?

A husband divorced the wife, she is in iddah, she is from overseas,she now wants to go back overseas and take the children with her. the husband lives here locally. the children are all girls aged 11, 7, 3 who gets custody of the children?.

What is the ruling from shareeah?

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Muhtaram Moulana Asad Saheb Madda Zillahuu. Assalamu Alaikum.

At the outset, we wish to point out that a divorcee is obliged to observe the laws of iddat at her husband’s residence.[1]

Upon the expiry of iddah, she may travel abroad with her mahram, for example, father, brother, etc.

Muhtaram Moulana, obviously, the ideal solution would be to attempt a reconciliation and avoid a break up of the marriage with all the negative consequences.

(1) وَلَكِنْ فِي الْخَانِيَّةِ وَالْمُتَوَفَّى عَنْهَا زَوْجُهَا تَخْرُجُ بِالنَّهَارِ لِحَاجَتِهَا إلَى نَفَقَتِهَا وَلَا تَبِيتُ إلَّا فِي بَيْتِ زَوْجِهَا اهـ.

فَظَاهِرُهُ أَنَّهَا لَوْ لَمْ تَكُنْ مُحْتَاجَةً إلَى النَّفَقَةِ لَا يُبَاحُ لَهَا الْخُرُوجُ نَهَارًا (البحر الرائق شرح كنز الدقائق ومنحة الخالق وتكملة الطوري (4/ 167)

(2) قَالَ فِي الْهِدَايَةِ: وَأَمَّا الْمُتَوَفَّى عَنْهَا زَوْجُهَا فَلِأَنَّهُ لَا نَفَقَةَ لَهَا فَتَحْتَاجُ إلَى الْخُرُوجِ نَهَارًا لِطَلَبِ الْمَعَاشِ وَقَدْ يَمْتَدُّ إلَى أَنْ يَهْجُمَ اللَّيْلُ وَلَا كَذَلِكَ الْمُطَلَّقَةُ لِأَنَّ النَّفَقَةَ دَارَّةٌ عَلَيْهَا مِنْ مَالِ زَوْجِهَا. اهـ.

قَالَ فِي الْفَتْحِ: وَالْحَاصِلُ أَنَّ مَدَارَ حِلِّ خُرُوجِهَا بِسَبَبِ قِيَامِ شُغْلِ الْمَعِيشَةِ فَيَتَقَدَّرُ بِقَدْرِهِ، فَمَتَى انْقَضَتْ حَاجَتُهَا لَا يَحِلُّ لَهَا بَعْدَ ذَلِكَ صَرْفُ الزَّمَانِ خَارِجَ بَيْتِهَا. اهـ. وَبِهَذَا انْدَفَعَ قَوْلُ الْبَحْرِ إنَّ الظَّاهِرَ مِنْ كَلَامِهِمْ جَوَازُ خُرُوجِ الْمُعْتَدَّةِ عَنْ وَفَاةٍ نَهَارًا وَلَوْ كَانَ عِنْدَهَا نَفَقَةٌ، وَإِلَّا لَقَالُوا: لَا تَخْرُجُ الْمُعْتَدَّةُ عَنْ طَلَاقٍ، أَوْ مَوْتٍ إلَّا لِضَرُورَةٍ فَإِنَّ الْمُطَلَّقَةَ تَخْرُجُ لِلضَّرُورَةِ لَيْلًا، أَوْ نَهَارًا اهـ.
