Is it permissible to consume and sell e cigarettes?

I have read your previous answers on the ruling of e cigarettes, however, that answer was dated 2009 and you had stated that at the time there was no clear evidence on whether the use of e cigarettes was harmful or not. 5 years on. I would like to ask what your ruling is now on the use of e cigarettes and also the involvement in selling e cigarettes i.e are these things permissible.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is makrūh (disliked) to use and/or deal in e-cigarettes[1].

We have conducted research on e-cigarettes and thereby the following is deduced from our analysis:

1.             There are different types of e-cigarettes and thus they cannot all be tarred with the same brush.

•              The user can choose whether or not to have nicotine in the flavoured liquid solution

•              The solutions come in varying levels of nicotine concentrations, ranging from zero to extra-high (24-36 mg/ml).

أما الأكل فعلى مراتب: فرض، وهو ما يندفع به الهلاك، فإن ترك الأكل والشرب حتى هلك فقد عصى. ومأجور عليه، وهو ما زاد عليه ليتمكن من الصلاة قائما ويسهل عليه الصوم. ومباح، وهو ما زاد على ذلك إلى الشبع لتزداد قوة البدن، ولا أجر فيه، ولا وزر ويحاسب عليه حسابا يسيرا إن كان من حل. وحرام، وهو الأكل فوق الشبع إلا إذا قصد به التقوي على صوم الغد أو لئلا يستحيي الضيف فلا بأس بأكله فوق الشبع، ولا تجوز الرياضة بتقليل الأكل حتى يضعف عن أداء الفرائض، فأما تجويع النفس على وجه لا يعجز عن أداء العبادات فهو مباح، وفيه رياضة النفس وبه يصير الطعام مشتهى بخلاف الأول، فإنه إهلاك النفس، وكذا الشاب الذي يخاف الشبق لا بأس بأن يمتنع عن الأكل ليكسر شهوته بالجوع على وجه لا يعجز عن أداء العبادات، كذا في الاختيار شرح المختار.

2.             Many answers to questions on e-cigarettes remain unanswered and unknown by medical experts themselves

•              The long-term health risks associated with the e-cigarette remain unknown;

•              Some manufacturers may only disclose flawed, inadequate and vague details of all the chemical ingredients and the nicotine in their e-cigarettes. The product labelling renders gives insufficient or vague information on the liquids used;

•              The safety of e-cigarettes is yet to be proven in large studies of long-term consumption;

•              The effect of e-cigarette during pregnancy is unknown.

The e-cigarette makers have not conducted the research necessary to prove that the vapour produced by e-cigarettes is harmless.

3.             Studies have revealed mixed conclusions

Argument in favour of e-cigarettes

•              E-cigarettes are generally seen, advocated and marketed as a healthier alternative and replacement to standard cigarettes. However, there is no clear and convincing evidence that e-cigarettes is effective in assisting addicted tobacco smokers to quit. Accordingly, the World Health Organization (WHO) “does not consider it to be a legitimate therapy for smokers trying to quit”. (http://www.who.int/mediacentre/news/releases/2008/pr34/en/index.html ) Furthermore, e-cigarettes appear safer and therefore more attractive to teens; and eventually it may encourage more habitual consumption of nicotine.

Arguments against e-cigarettes

•              It may cause lung damage (Research presented at the European Respiratory Society’s Annual Congress 2012);

•              It pollutes the air, albeit less than classic cigarettes, and thus affect innocent bystanders;

•              It produces gases which are not innocuous (A contemporary  European study in the International Journal of Hygiene and Environmental Health);

•              It contains chemicals toxic to human beings – the United States Food and Drug Administration (USFDA) “found that they contain carcinogens and toxic chemicals such as diethylene glycol, an ingredient used in antifreeze” (http://www.fda.gov/NewsEvents/Newsroom/PressAnnouncements/ucm173222.htm  )

•              It contains nicotine which is addictive and toxic at high doses;

•              It acts as gateway device for non-smokers to start smoking classic cigarettes.

Ruling on e-cigarettes

We, thus, conclude that, although there are many issues relating to e-cigarettes which are unknown, there is the overwhelming potential of harm to the user and the society to render e-smoking and/ or selling e-cigarettes to be makrūh (undesirable).

However, the ruling is subject to the following: 1. Future medical studies 2. The type of consumer (an already smoker of classic cigarettes or non-smoker) 3. The type of, and the amount of, e-cigarettes consumed.

In principle, there are three issues with e-cigarettes: 1. Potential harm to body; 2. Potential harm to others 3. Imitation of smokers.

1. Potential harm to body

أكل الطين مكروه، هكذا ذكر في فتاوى أبي الليث – رحمه الله تعالى – وذكر شمس الأئمة الحلواني في شرح صومه إذا كان يخاف على نفسه أنه لو أكله أورثه ذلك علة أو آفة لا يباح له التناول، وكذلك هذا في كل شيء سوى الطين، وإن كان يتناول منه قليلا أو كان يفعل ذلك أحيانا لا بأس به، كذا في المحيط.

الطين الذي يحمل من مكة ويسمى طين حمزة هل الكراهية فيهكالكراهية في أكل الطين على ما جاء في الحديث؟ قال: الكراهية في الجميع متحدة، كذا في جواهر الفتاوى.

وسئل بعض الفقهاء عن أكل الطين البخاري ونحوه قال لا بأس بذلك ما لم يضر وكراهية أكله لا للحرمة بل لتهييج الداء، وعن ابن المبارك كان ابن أبي ليلى يرد الجارية من أكل الطين وسئل أبو القاسم عمن أكل الطين قال ليس ذلك من عمل العقلاء، كذا في الحاوي للفتاوى.

والمرأة إذا اعتادت أكل الطين تمنع من ذلك إذا كان يوجب نقصانا في جمالها، كذا في المحيط.

الاستفسار: هل يجوز أكل النورة في الورق المأكول في أمصار الهند، وهو التنبول؟

الاستبشار: نعم؛ في ((نصاب الاحتساب)).

وذكر الحلواني: أن أكل الطين إن كان يضر يكره، وإلا فلا، وإن كان يتناوله قليلا، أو يفعله أحيانا لا يكره، قال العبد ـ أصلح الله شأنه ـ: ويقاس على هذا أنه يباح أكل النورة مع الورق المأكول في ديار الهند ؛ لأنه

قليل نافع، فإن الغرض المطلوب من الورق المذكور لا يحصل بدونها، وهو الحمرة. انتهى.

وقد نقل عنه في ((خزانة الروايات))، و((مجمع البركات)) أيضا

2. Potential harm to others

 

E-cigarettes produce gases which are not innocuous and thereby they pollute the air affecting the innocent bystanders – which is more detrimental in harming others than harming them by the mere smell of something (which has been considered in Sharia).

ومن أكل ما يتأذى به: أي برائحته كثوم وبصل ويؤخذ منه أنه لو تأذى من رائحة الدخان المشهور له منهما من شربه

قيل لأنس : ما سمعت النبي صلى الله عليه وسلم في الثوم؟ فقال : من أكل فلا يقربن مسجدنا

عن جابر قال قال رسول الله صلى الله عليه وسلم: من أكل من هذه الشجرة المنتنة فلا يقربن مسجدنا فإن الملائكة تتأذى مما يتأذى منه الأنس

3. Imitation of smokers

 

أكل الطين مكروه لأنه تشبه بفرعون فإن فرعون لم يكن إلا أكل الطين
