Do we have to return at the present cost of the belongings?

Answered as per Hanafi Fiqh by Askimam.org

I asked a question regarding what to do with in laws furniture after divorce, which was answered in Fatwa: 27824.I want to know whether we have to return at the present cost of the belongings or at the cost of buying those, incase we return in money ? A cse is going on court where she may claim for a monthly payment by my brother,if we give that money from the cost of the belongings would it be a proper return of the things ?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

You must return the actual items, not their value. As stated in the previous Fatwa, please seek legal advice for returning the items.

Please clarify what the claim for a monthly payment is for. You may forward the clarification to admin@daruliftaa.net
