What should be done with the furniture and items given by the in laws after divorce?

Answered as per Hanafi Fiqh by Askimam.org

Before three years ago my elder brother was married. His new wife didnt make home with him and staying only 5 days after marriage she went to her home and never came. She mainly withdrew the relationship because of she thinks my brother is a little bit abnormal and she cant adjust with him. After 2 years they(my brother’s in laws people) alleged a case in court regarding domestic violence towards her against all of us.

They gave some furniture, a golden ring, and some clothings with her .Except the jewelries she went leaving everything to our house. When we ask them to come and take those they strongly denied and even they didnt wanted to talk with us.Now I want to know that if using of those things are permissible to us.

If not then what we shall do with those things. We afraid to return them because they may deny after taking those and latter again demand for those in court, they are a kind of tricky people. And truly speaking we were so disturbed by this two years that we forgot to think about those belongings to us and by the time as those were in my brother’s room he used to use those(mainly bed, almirah)and sometimes we also used that. One thing I forgot to say is those were not our demands but they gave with their girl.

Kindly tell me what to do with those ,as my brother is going to be married again and we dont want to keep their things.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If the girl’s family gave the furniture to her, then it belongs to her and it should be returned to her. Seek legal advice on how to return the furniture to the girl or her family.
