I wanted to know that if a person prays to ALLAH ALMIGHTY for some of his work which he wants to be done by the grace of ALLAH ALMIGHTY and he commits that if the work is done for him he will say certain big no. of Nafil Namaz, and then if his work is completed and he is not able to say those Nafil namaz, is there any kaffara which he can give instead of praying those Nafil namaz ? For example if he by chance commits to say Nafil namaz in thousand and now he is not able to pray that much, can he give any kind of kaffara instead of those Nafil Namaz ? Walikum Asalam

Assalaamu `alaykum waRahmatullahi Wabarakatuh

If the person only makes this intention in his mind but never actually mentions it with his tongue, then the nafl prayers are not binding on him [i]. 

However, if he had uttered the words of this vow, then all the nafl prayers, even if in the thousands, will become binding on him [ii].  He may not substitute these with any form of kaffārah [iii].  InshāAllāh, he may do only a few nafl prayers each day and do it over a period until he completes all of them.  However, it is better for him to try to finish them quicker [iv].

فركن النذر هو الصيغة الدالة عليه وهو قوله لله عز شأنه علي كذا أو على كذا أو هذا هدي أو صدقة أو مالي صدقة أو ما أملك صدقة ونحو ذلك

وأما المعلق فظاهر الرواية أنه يلزمه الوفاء به عند وجود الشرط كما في الظهيرية واختار المحققون أنه إن كان معلقا على شرط يريد كونه لجلب منفعة أو دفع مضرة كإن شفى الله مريضي أو مات عدوي فلله علي صوم أو صدقة أو صلاة لا يجزئه إلا فعل عينه وإن كان معلقا على شرط لا يريد كونه كإن دخلت الدار أو كلمت فلانا كان مخيرا بين الوفاء به وبين كفارة اليمين وصححه في الهداية وقال إن أبا حنيفة رجع عن غيره وكذا في الظهيرية وبه كان يفتى إسماعيل الزاهد

أما إذا كان النذر معلقا بالشرط وإنه على وجهين أيضا إن كان شرطا يريد ودوده إما لجلب منفعة أو لدفع مضرةفوجد الشرط يلزمه الوفاء بما سمى ولا يخرج عن العهدة بالكفارة أيضا يلا خلاف

وسواء كان النذر مطلقا أو مقيدا أو معلقا بشرط بأن قال إن فعلت كذا فعلي لله حج أو عمرة أو صوم أو صلاة أو ما أشبه ذلك من الطاعات حتى لو فعل ذلك يلزمه الذي جعله على نفسه ولم يجز عنه كفارة وهذا قول أصحابنا رضي الله عنهم

سواء كان النذر مطلقا أو معلقا بشرط بأن قال إن فعلت كذا فلله علي أن أحج حتى يلزمه الوفاء إذا وجد الشرط ولا يخرج بالكفارة في ظاهر الرواية عن أبي حنيفة رحمه الله تعالى
