in UAE,…it is mandatory to have insurance for our cars…therefore we have to do it….and on top of that…the insurance company offers some benefits such as road side assistance..help in case of breakdown of cars and so on….so is halal to avail these benefits??

what do we do of the tasbeeh which is broken…should we just discard it ?? or throw it in sea or what…

Assalaamu `alaykum waRahmatullahi Wabarakatuh

1. Subscribing to conventional insurance is not permissible as it involves interest and gambling, both of which are expressly forbidden in the Shariah. If, however, one is obliged by the law of the country to do so, then he will be excused. However, based on the principle of the Shariah الضرورة تقدر بقدرها  , only the minimum level that satisfies the legal requirements will be permissible. Hence, if subscribing to third party insurance fulfils the legal requirements, it will not be permissible to subscribe to comprehensive insurance etc. Since, usually, receiving benefits such as road side assistance requires payment of extra amount on top of the premium of the third party insurance, it will not be permissible to subscribe to such offers.

2. Some sahabah used to keep date pits and pebbles for the purpose of keeping count of zikr; however, there is no mention in the hadith books or the fiqh books, that we came across, of any specific method of discarding them. Therefore, according to the principal الأصل في الأشياء الإباحة , it will be permissible to discard the beads of the broken tasbeehs by throwing them away, burying them or throwing them in the ocean etc.. They would be like discarding anything else that a person used for the purpose of khair (good) such as clippings of pencil used to impart knowledge, clothes used to offer salah, shoes used for going to the masjid etc.

مطلب الكلام على اتخاذ المسبحة ( قوله لا بأس باتخاذ المسبحة ) بكسر الميم : آلة التسبيح ، والذي في البحر والحلية والخزائن بدون ميم قال في المصباح : السبحة خرزات منظومة ، وهو يقتضى كونها عربية وقال الأزهري : كلمة مولدة ، وجمعها مثل غرفة وغرف ا هـ والمشهور شرعا إطلاق السبحة بالضم على النافلة قال في المغرب : لأنه يسبح فيها ودليل الجواز ما رواه أبو داود والترمذي والنسائي وابن حبان والحاكم وقال صحيح الإسناد عن سعد بن أبي وقاص { أنه دخل مع رسول الله صلى الله عليه وسلم على امرأة وبين يديها نوى أو حصى تسبح به فقال : أخبرك بما هو أيسر عليك من هذا أو أفضل ؟ فقال : سبحان الله عدد ما خلق في السماء ، وسبحان الله عدد ما خلق في الأرض ، وسبحان الله عدد ما بين ذلك ، وسبحان الله عدد ما هو خالق ؛ والحمد لله مثل ذلك ، والله أكبر مثل ذلك ، ولا إله إلا الله مثل ذلك ، ولا حول ولا قوة إلا بالله مثل ذلك } : فلم ينهها عن ذلك وإنما أرشدها إلى ما هو أيسر وأفضل ولو كان مكروها لبين لها ذلك ، ولا يزيد السبحة على مضمون هذا الحديث إلا بضم النوى في خيط ، ومثل ذلك لا يظهر تأثيره في المنع ، فلا جرم أن نقل اتخاذها والعمل بها عن جماعة من الصوفية الأخيار وغيرهم ؛ اللهم إلا إذا ترتب عليه رياء وسمعة فلا كلام لنا فيه ، وهذا الحديث أيضا يشهد لأفضلية هذا الذكر المخصوص على ذكر مجرد عن هذه الصيغة ولو تكرر يسيرا كذا في الحلية والبحر ( رد المحتار: ج 2 ص 508 دار المعرفة )
