In the name of Allah, Most Gracious, Most Merciful

Assalaamu `alaykum waRahmatullahi Wabarakatoh

Pictures and sculptures resembling living beings are prohibited in Shari’ah. Dolls, stuffed animals, etc. are not permissible if they are fully structured figures. This means that if they resemble living beings with prominent features such as eyes, a nose, mouth, ears, body structure, etc. then it will not be permissible for one to purchase them, gift them, or for children to play with them.

Rasulullah (Sallallahu Alayhi Wasallam) has said in Hadith:

“Whoever makes pictures, indeed Allah will punish him until he (the person being punished) is able to infuse life into his soul, and he will never be able to do this” (Bukhari)

“The angels will not enter those houses in which there is a dog or pictures” (Bukhari)

There are several reasons for these prohibitions. Firstly, it is considered to be Mudahat li-khalqillah (trying to emulate Allah Ta’ala’s ability of creating). Second, it was the idol worshippers who used to carve tamaathil (statues, sculptures) for their idols. Finally, the prohibition was a clear order of Rasulullah (Sallallahu Alayhi Wasallam) and as believers it is incumbent upon us to abide by the orders of Allah Ta’ala and Rasulullah (Sallallahu Alayhi Wasallam) without questioning.

The Hadith of the doll of Hadhrat Aisha (RadiyAllahu Anha) was prior to the Hadith of the prohibition of pictures of animate objects. Hence, that Hadith is abrogated.

حدثنا عبد الله بن عبد الوهاب حدثنا يزيد بن زريع أخبرنا عوف عن سعيد بن أبي الحسن قال

 : كنت عند ابن عباس رضي الله عنهما إذ أتاه رجل فقال يا أبا عباس إني إنسان إنما معيشتي من صنعة يدي وإني أصنع هذه التصاوير . فقال ابن عباس لا أحدثك إلا ما سمعت رسول الله صلى الله عليه و سلم يقول سمعته يقول ( من صور صورة فإن الله معذبه حتى ينفخ فيها الروح وليس بنافخ فيها أبدا )-بخاري

عن ابن عباس عن أبى طلحة – رضى الله عنهم – قال قال النبى – صلى الله عليه وسلم – « لا تدخل الملائكة بيتا فيه كلب ولا تصاوير »-بخاري

وظاهر كلام النووي في شرح مسلم الإجماع على تحريم تصوير الحيوان ، وقال : وسواء صنعه لما يمتهن أو لغيره ، فصنعته حرام بكل حال لأن فيه مضاهاة لخلق الله تعالى ، وسواء كان في ثوب أو بساط أو درهم وإناء وحائط وغيرها

ويحتمل أن يكون مخصوصا من أحاديث النهي عن اتخاذ الصور لما ذكر

من المصلحة ويحتمل أن يكون قضية عائشة رضي الله عنها هذه في أول الهجرة قبل تحريم الصور
