Q-regarding tayamum you mentioned to the near meaning that if unable to wash majority of the parts(3 out of 4) in wudu then its permissible or else not, but in Aap ke Masail or un ka hal part 2 ….

Q-regarding tayamum you mentioned to the near meaning that if unable to wash majority of the parts(3 out of 4) in wudu then its permissible or else not, but in Aap ke Masail or un ka hal part 2 chapter tayamum theres a question where the sick is unable to wash his face only so Maulana Yusuf Ludhyanvi R.A has given permission of tayamum even though he is able to wash majority of the parts only the face he can’t wash so is is there a difference of oppinion and is there a leeway that if one part like only the face  can’t be wash then tayamum is permissible or is the masala of Aap ke Masail or un ka hal part 2 chapter tayamum wrong?Please explain because a Maulana saheb gave the above reference and said its permissible,the patient is very confused about what to do. Is there any referene in Baheshti Zewar regarding the above?

It is understood from the following texts that if one is unable to make masah of his head should leave it out and wash all other areas.

من به وجع رأس لا يستطيع مسحه سقط فرض مسحه – الدر المنتقى في شرح الملتقى (ج1/ص68) المكتبة الغفارية

وأفتى قارئ الهداية أنه ( يسقط ) عنه ( فرض مسحه ) ولو عليه جبيرة ، ففي مسحها قولان ، وكذا يسقط غسله فيمسحه ولو على جبيرة إن لم يضره ، وإلا سقط أصلا وجعل عادما لذلك العضو حكما كما في المعدوم حقيقة – الدر المختار (1/486) دار المعرفة

( قوله ولو على جبيرة ) ويجب شدها إن لم تكن مشدودة ط أي إن أمكنه ( قوله وإلا ) أي بأن ضره المسح عليها ، والله سبحانه وتعالى أعلم – رد المحتار (1/486) دار المعرفة

وذكر شمس الأئمة الحلواني إذا كان في أعضائه شقاق وقد عجز عن غسله سقط عنه فرض الغسل ويلزم إمرار الماء عليه فإن عجز من إمرار الماء يكفيه المسح فإن عجز عن المسح سقط عنه المسح أيضا فيغسل ما حوله ويترك ذلك الموضع  – الفتاوى الهندية (1/5) المكتبة الرشيدية

The following texts clearly state that if less than half of the wudhu limbs cannot be washed then wudhu must be done – not tayammum. In this case the sound parts will be washed normally and the affected areas will be wiped with wet palms; if that is harmful then a bandage should be wrapped around it and it should be wiped on with wet palms; if that is also harmful then the area should just be left out. Only if more than half of the wudhu limbs cannot be washed will tayammum be done.

( فإن كان أكثر الأعضاء ) أي أكثر أعضاء الوضوء ( جريحا ) في الحدث الأصغر أو أكثر جميع بدنه في الحدث الأكبر ( يتيمم ) ولا يجوز أن يغسل الصحيح ويمسح الجريح ( وإلا ) أي وإن لم يكن أكثر الأعضاء جريحا بل مساويا أو أكثر الأعضاء صحيحا ( غسل الصحيح ومسح على الجريح ) إن لم يضره وإلا فعلى الخرقة ، ولا يجوز التيمم ؛ لأن للأكثر حكم الكل- مجمع الأنهر  (ج1/ص67) المكتبة الغفارية

تيمم لو) كان (أكثره) أي أكثر أعضاء الوضوء عددا وفي الغسل مساحة (مجروحا) أو به جدري اعتبارا للاكثر (وبعكسه يغسل) الصحيح ويمسح الجريح (و) كذا (إن استويا غسل الصحيح) من أعضاء الوضوء، ولا رواية في الغسل (ومسح الباقي) منها (وهو) الاصح لانه (أحوط) فكان أولى، وصحح في الفيض وغيره التيمم، كما يتيمم لو الجرح بيديه وإن وجد من يوضيه خلافا لهما  الدر المختار (1/481) دار المعرفة

( قوله ويمسح الجريح ) أي إن لم يضره وإلا عصبها بخرقة ومسح فوقها خانية وغيرها ومفاد كما قال ط أنه يلزمه شد الخرقة إن لم تكن موضوعة – رد المحتار (1/481) دار المعرفة

وإن كان به جدري أو جراحات يعتبر الأكثر محدثا كان أو جنبا ففي الجنابة يعتبر أكثر البدن وفي الحدث يعتبر أكثر أعضاء الوضوء فإن كان الأكثر صحيحا والأقل جريحا يغسل الصحيح ويمسح على الجريح إن أمكنه وإن لم يمكنه المسح يمسح على الجبائر أو فوق الخرقة ولا يجمع بين الغسل والتيمم – الفتاوى الهندية (1/32) دار الكتب العلمية

( قوله : ولو أكثره مجروحا تيمم وبعكسه يغسل ) أي لو كان أكثر أعضاء الوضوء منه مجروحا في الحدث الأصغر أو أكثر جميع بدنه في الحدث الأكبر تيمم ، وإذا كان الصحيح أكثر من المجروح يغسل ؛ لأن للأكثر حكم الكل ويمسح على الجراحة إن لم يضره ، وإلا فعلى الخرقة – البحر الرائق (ج1/ص284) الرشيدية

والحاصل لزوم غسل المحل ولو بماء حار ، فإن ضر مسحه ، فإن ضر مسحها ، فإن ضر سقط أصلا الدر المختار (ج1/ص514) دار المعرفة

Since you asked for reference from Bahishti Zewar … It is written in Bahishti Zewar:

‘If there is a sore or some other wound on the hands, feet, etc. and one fears that it would be harmful to pour water over it, then water should not be poured. Instead, wet hand should be passed over the wound. This is called masah. If this is harmful, masah should not be made and that place should be left out.’

The above applies if the wound is on less than half of the wudhu limbs.

Talking about ghusl, it is written in Bahishti Zewar:

‘If someone has wounds on more than half of his body, or is suffering from small-pox, then it is not obligatory on him to bath. Instead, tayammum could be made.’

(Ibid vol. 1 pg. 89, Mas’ala #11 of Tayammum)

From the above it is understood that if he has wounds on less than half of his body, then he will have to do ghusl (masah will be done on the affected areas if it is not harmful; otherwise, it will be left dry).The same thing applies to wudhu. The difference between ghusl and wudhu is that in ghusl the majority of the body is taken into consideration, whereas in wudhu the majority of the limbs of wudhu are taken into consideration.

As for the fatwa of in Aap Ke Masail Aur Un Ka Hal (vol.2, pg.65) of doing tayammum for the person with severe acne on his face who could not even pass wet palms on his face for wudhu, we could not verify the basis of the fatwa. However, we did come across a fatwa in Fatawa Darul Ulum Deoband (vol. 1, pg. 190 Darul Isha’at) where it states that if one is unable to pass wet palms on the wound or on the bandage, then doing tayammum is valid. The reference given for the basis of the fatwa is the following text:

( ويترك ) المسح كالغسل ( إن ضر وإلا لا ) يترك   الدر المختار (ج1/ص517) دار المعرفة

However, upon studying the above text it is clear that it does not state that wudhu should be left out and that tayammum should be done. What it states is that if even doing masah on the bandage is harmful then it should just be left out. In other words, this particular limb should be left out but the rest of wudhu should be done normally. There is no mention of doing tayammum whatsoever. Below the text is reproduced in its context:

(وحكم مسح جبيرة) هي عيدان يجبر بها الكسر (وخرقة قرحة وموضع فصد) وكي (ونحو ذلك) كعصابة جراحة ولو برأسه (كغسل لما تحتها) فيكون فرضا: يعني عمليا لثبوته بظني، وهذا قولهما، وإليه رجع الامام خلاصة وعليه الفتوى شرح مجمع وقدمنا أن لفظ الفتوى آكد في التصحيح من المختار والاصح والصحيح ثم إنه يخالف مسخ الخف من وجوه ذكر منها ثلاثة عشر، فقال (فلا يتوقف) لانه كالغسل حتى يؤم الاصحاء، ولو بدلها بأخرى أو سقطت العليا لم يجب إعادة المسح، بل يندب (ويجمع) مسح جبيرة رجل (معه) أي مع غسل الاخرى لا مسح خفها بل خفيه (ويجوز) أي يصح مسحها (ولو شدت بلا وضوء) وغسل دفعا للحرج (ويترك) المسح كالغسل (إن ضر وإلا لا) يترك (وهو) أي مسحها (مشروط بالعجز عن مسح) نفس الموضع (فإن قدر عليه فلا مسح) عليهاوالحاصل لزم غسل المحل ولو بماء حار، فإن ضر مسحه، فإن ضر مسحها، فإن ضر سقط أصلا الدر المختار (ج1/ص517) دار المعرفة

From the last sentence it is clear that the obligation of the particular limb will become annulled (i.e. that is should be left out) – not the obligation of the entire wudhu. Ibn Aabideen Ash-Shaami also makes the issue clear:

( قوله ويترك المسح كالغسل ) أي يترك المسح على الجبيرة كما يترك الغسل لما تحتها  رد المحتار (ج1/ص517) دار المعرفة

There is no mention of leaving wudhu and doing tayammum.

The conclusion of all the above is: the correct position is that if a person has wounds etc. on less than half of the wudhu limbs he should do wudhu by washing all the sound parts and making masah on the wounded area. If making masah is harmful then a bandage should be wrapped around it and masah should be done on it. If that is also not feasible or harmful then that area should be left out. Tayammum will only be allowed if more than half of the wudhu limbs have wounds. In the case of the brother who had a brain tumor operation, since more than half of his wudhu limbs can be washed, he should do wudhu.
