Can a man marry his niece from his half sister?

Asalamualaykum Wa Rahmatullahi Wa barakatuhu

I would like for you to please clarify whether it is allowed for a man to marry his neice; given that her mother is his real half sister (i.e. they share the same father not mother)? Please respond soon.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is not permissible for one to marry his niece even if she is from his half-sister.[i][ii] [iii] This prohibition comes from the verse[iv]:

{حُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ وَبَنَاتُكُمْ وَأَخَوَاتُكُمْ وَعَمَّاتُكُمْ وَخَالَاتُكُمْ وَبَنَاتُ الْأَخِ وَبَنَاتُ الْأُخْتِ وَأُمَّهَاتُكُمُ اللَّاتِي أَرْضَعْنَكُمْ وَأَخَوَاتُكُمْ مِنَ الرَّضَاعَةِ وَأُمَّهَاتُ نِسَائِكُمْ}

“Prohibited for you are your mothers, yours daughters, your sisters, your paternal aunts, your maternal aunts, your brother’s daughters, your sister’s daughters, your foster mothers who breast fed you, your foster sisters, the mothers of your wives…”

وَالْمُحَرَّمَاتُ عَلَى التَّأْبِيدِ ثَلَاثَةُ أَنْوَاعٍ:

مُحَرَّمَاتٌ بِالْقَرَابَةِ وَمُحَرَّمَاتٌ بِالْمُصَاهَرَةِ وَمُحَرَّمَاتٌ بِالرَّضَاعِ…….

وَالسَّابِعُ بَنَاتُ الْأُخْتِ تَثْبُتُ حُرْمَتُهُنَّ بِقَوْلِهِ تَعَالَى {وَبَنَاتُ الْأُخْتِ} [النساء: 23] وَيَسْتَوِي فِي ذَلِكَ أَوَّلًا بَنَاتُ الْأُخْتِ لِأَبٍ وَأُمٍّ أَوْ لِأَبٍ أَوْ لِأُمٍّ
