Mufti saheb

This is another musafir masalah

I am from roshnee, studying in Azaadville

(distance roshnee-Azaadville=76 Km)

My wife is from rustenburg which is +-100 km to Azaadville

So we staying together here in Azaadville, but i do not intend ever settling down here because i have to basically just finish my studies.

Ps We usually don’t stay here for more than 15 days

So can the following intentions be permissible

My niyyah: my darul watan is still roshnee, i make niyyah for safr when i leave roshnee intending to continue my journey more than musafir distance, and stay in Azdvlle for less than 15 days (by our flat) 

My wife’s niyyah: she keeps rustenburg as her darul watan as she hasn’t established herself anywhere else yet, not roshnee nor Azaadville

Azaadville is just a darus safr as she will not stay for more than 15 days like myself

She reads qasr when in Roshnee so do I read qasr in rustenburg

Are these intentions correct or should we change our niyyah to base ourselves in Azaadville. And work accordingly

Or what is mufti Saheb’s opinion? 

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

We take note of the content of your query and advise:

You refer to Roshnee, Azaadville and Rustenburg and your intentions during the travels. You enquire what is our opinion. Our advise to you and your wife is to establish Azaadville as your Watan-e-Iqamah by taking a longer route to Azaadville making it 78km (Safar-e-Sharee) and make the intention of staying in Azaadville for 15 nights or more. This must only be done once, so that Watan-e-Iqamah can be established in Azaadville.[1] Roshnee will remain your Watan-e-Asli.

Accordingly, you and your wife[2] will be Muqeems in Azaadville and make Itmaam of your Salaah, irrespective of intending to stay 15 nights or more.[3]

In Roshnee, you and your wife will be Muqeems and make Itmaan there when travelling from Azaadville taking the normal route. This is due to Roshnee being Watan-e-Asli for you and also it is not a Safar-e-Sharee from Azaadville for you and your wife.

In Rustenburg you will be a Musafir and you must perform Qasr if you intend staying lesser than 15 nights. This will apply irrespective of travelling from Roshnee or Azaadville, as Rustenburg will be a Safar-e-Sharee.[4]

In Rustenburg your wife will be a Muqeem and she must make Itmaam, due to it being her Watan-e-Asli.

من جاوز بيوت مصره مريدًا سيرًا وسطًا ثلاثة أيّامٍ في برٍّ أو بحرٍ أو جبلٍ قصر الفرض الرّباعيّ فلو أتمّ وقعد في الثّانية صحّ وإلّا لا حتّى يدخل مصره أو ينوي إقامة نصف شهرٍ ببلدٍ أو قريةٍ

وتعتبر نية الإقامة والسفر من الأصل دون التبع)؛ لأن الأصل هو المتمكن من الإقامة والسفر دون التبع قال – رحمه الله – (كالمرأة والعبد والجندي) هذا تفسير التبع أي المرأة تبع للزوج والعبد تبع للمولى والجندي تبع للأمير والمرأة إنما تكون تبعا للزوج إذا وفاها مهرها المعجل

وأما بيان ما يصير المسافر به مقيما: فالمسافر يصير مقيما بوجود الإقامة، والإقامة تثبت بأربعة أشياء: أحدها: صريح نية الإقامة وهو أن ينوي الإقامة خمسة عشر يوما في مكان واحد صالح للإقامة فلا بد من أربعة أشياء: نية الإقامة ونية مدة الإقامة، واتحاد المكان، وصلاحيته للإقامة
