Can husband travel with toddler without wife’s permission?

Question: My husband and I reside in the United States. My husband wishes to travel to Pakistan with our toddler. I do not want him to do this. Can he do this?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, the mother possesses the right of custody (hadhana) during the marriage. Accordingly, her husband is not permitted to travel such a distance with the child without her permission.[1] We advise the couple to come to a mutual agreement, thereby settling the issue.
