My husband gave me another Talāq during my iddah. How long do i have to sit in Iddah?

Trust you are well, 

I was sitting my idith on my second talaak and he issed me a third talaak. 

 

How long do I have to sit?

Answer

In the name of Allah, Most Gracious, Most Merciful 
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh

In principle, if a woman is issued talāq in her iddat, then the iddat will not be extended based on the talāq given during the iddat period.[1]

In the enquired situation, the third talāq issued within the iddat will not extend the iddat period, your iddat period will be counted from the second talāq.

Your statement is unclear regarding the condition you were in when your husband issued you a talāq.Therefore, in your iddat:

1.      If you were pregnant then you would remain in your iddat until you deliver the child. Once the child is born, your iddat will expire, even if the child is  born a few days after being divorced.[2]

 

2.     If you were in menses, then the period of menses will not be counted. Your iddat will be complete upon the expiry of three menstrual periods after the menstrual period that you are presently experiencing.[3]

 فلو كانت حاملاً فتزوجت؟ قال: النكاح فاسد. لا ينبغي لها أن تتزوج حتى تضع حملها.

شرح مختصر الطحاوي للجصاص (5/ 240)

قال: (وعدة الحامل في جميع هذه الوجوه أن تضع حملها).

لقوله تعالى: {وأولات الأحمال أجلهن أن يضعن حملهن}، وذلك عموم في الجميع؛ لأنه لفظ مكتف بنفسه عن تضمينه لغيره.

ويروى عن علي بن أبي طالب، وابن عباس رضي الله عنهما أن عدة المتوفى عنها زوجها إذا كانت حاملًا أبعد الأجلين، يعني وضع الحمل أو مضي أربعة أشهر وعشر.

وقال عمر، وابن مسعود، وابن عمر، وأبو مسعود البدري: عدتها أن تضع حملها

وإذا طلق الرجل امرأته وهي حائض فإنها لا تعتد بتلك الحيضة (1) من عدتها، وعليها ثلاث حيض بعدها. وإن طلقها أخرى بعد ذلك فإنما عدتها من التطليقة الأولى ثلاث حيض، ولا تعتد بالحيضة التي طلقها فيها. بلغنا ذلك عن شريح وابن عباس وإبراهيم (2)
