Waswasa, and the status of my marriage.

Salamu alaikum, i am in a big problem. pleaes help me if you can. I’ve been restless and suffering from lots of waswas because of this question. 

I am a married man, i have a 3 year old son, and i love my wife and son. I’ve been suffering from waswas about my marriage being valid or not for a few months. Lots of thougts are coming to my mind, and i am having really hard time trying to stay away from these. 

My question is:

I have had lots of fights with my wife before. And i was not aware of many rules of Islam. When i read about some fatwas about marriage, and they word i can’t tell because of waswas, and i am afraid i will think of something bad if i type the word. So i am having this thought that at some point while i was having a discussion about our future and our life, sometimes i feel like i told my wife in a conversation that look we should stop fighting, and if we continue that, we will end up in _____. But then again i think i might not have said it, and said something like if something happens between us, what will happen to our son. And i am not sure what i said, but i think most probably i have said the later one. But if i said the first one, it was not to give a condition, that is what i can clearly remember that i have never gave my wife any condition at all. It was just a part of our discussion about future. I swear by allah that i didnt have any intention to give her any condition. I am not even sure if i have actually said it. And like i said before, i am suffering from waswas badly. i can’t talk to my wife because i am afraid i will say something that might be considered implicit word. 

Plesae help me if you can.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Brother in Islam.

We understand your difficulty. May Allah Ta’āla alleviate you from your difficulty. Aameen.

In principle, if one person is certain that he did not give divorce to his wife, then the divorce does not occur. [1] 

Brother, you have clearly mentioned in your question that you are absolutely sure you never gave your wife any condition at all. Hence, divorce did not occur, and your marriage is intact.

Your waswasa are whispers of Shaitān and evil thoughts that comes in your mind, simply ignore such thoughts, you should dispel these doubts and carry on with your marriage.

Whenever you experience waswasa, you should recite: [2]

أعوذُ باِللهِ مِنَ الشَّيطَانِ الرَّجِيم 

(I seek refuge in Allah from the rejected devil.)

لاحول ولا قوة إلا بالله

(There is no power and no strength except with Allah)

وَنَعُوذُ بِاللَّهِ مِنْ شُرُورِ أَنْفُسِنَا، وَمِنْ سَيِّئَاتِ أَعْمَالِنَا  

(We seek refuge in Allah from whatever evil our hearts conceal and from the consequences of our evil deeds). [3]

أَعُوذُ بِكَ مِنْ شَرِّ نَفْسِي، وَمِنْ شَرِّ الشَّيْطَانِ وَشِرْكِهِ 

(I seek refuge in you from the evil of my soul and from the evil of Satan and his companions). [4]

باب الطَّلاَقِ فِى الإِغْلاَقِ، والْمُكْرَهِ، وَالسَّكْرَانِ وَالْمَجْنُونِ وَأَمْرِهِمَا، وَالْغَلَطِ وَالنِّسْيَانِ فِى الطَّلاَقِ وَالشِّرْكِ وَغَيْرِهِ لِقَوْلِ النبي صلى الله عليه وسلّم: «اْلأَعْمَالُ بِالنّيةِ، وَلِكُلِّ امْرِىءٍ ما نَوَى». وَتَلاَ الشَّعْبِيُّ: {لاَ تُؤَاخِذْنَا إِن نَّسِينَا أَوْ أَخْطَأْنَا} [البقرة: 286]، وَما لاَ يَجُوزُ مِنْ إِقْرَارِ المُوَسْوِسِ.

وَقالَ النَّبِيُّ صلى الله عليه وسلّم لِلَّذِي أَقَرَّ عَلَى نَفسِهِ: «أَبِكَ جُنُونٌ؟» وَقالَ عَلِيٌّ: بَقَرَ حَمْزَةُ خَوَاصِرَ شَارِفَيَّ، فَطَفِقَ النَّبِيُّ صلى الله عليه وسلّم يَلومُ حَمْزَةَ، فَإِذَا حَمْزَةُ قَدْ ثَمِلَ مُحْمَرَّةٌ عَينَاهُ، ثُمَّ قالَ حَمْزَةُ: هَل أَنْتُمْ إِلَّا عَبِيدٌ لأَبِي، فَعَرَفَ النَّبِيُّ صلى الله عليه وسلّم أَنَّهُ قَدْ ثَمِلَ، فَخَرَجَ وَخَرَجْنَا مَعَهُ. وَقالَ عُثْمانُ: لَيسَ لِمَجْنُونٍ وَلاَ لِسَكْرَانَ طَلاقٌ. وَقالَ ابْنُ عَبَّاسٍ: طَلاَقُ السَّكْرَانِ وَالمُسْتكْرَهِ لَيسَ بِجَائِزٍ. وَقالَ عُقْبَةُبْنُ عامِرٍ: لاَ يَجُوزُ طَلاَقُ المُوَسْوِسِ.

وَإِنَّمَا قَالَ: لَا يجوز طَلَاق الموسوس لِأَن الوسوسة حَدِيث النَّفس، وَلَا مُؤَاخذَة بِمَا يَقع فِي النَّفس.

وأما الموسوس فضبطه في الظهيرية في فصل التعزير بكسر الواو وفي المغرب رجل موسوس بالكسر ولا يقال بالفتح ولكن موسوس له أو إليه أي ملقى إليه الوسوسة وقال الليث: حديث النفس وإنما قيل موسوس؛ لأنه يحدث بما في ضميره وعن أبي الليث لا يجوز طلاق الموسوس يعني المغلوب في عقله عن الحاكم هو المصاب في عقله إذا تكلم تكلم بغير نظام.

عَنْ عَبْدِ اللَّهِ، رَضِيَ اللَّهُ عَنْهُ قَالَ: عَلَّمَنَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ التَّشَهُّدَ فِي الْحَاجَةِ: «إِنَّ الْحَمْدَ لِلَّهِ، نَسْتَعِينُهُ وَنَسْتَغْفِرُهُ، وَنَعُوذُ بِاللَّهِ مِنْ شُرُورِ أَنْفُسِنَا، وَمِنْ سَيِّئَاتِ أَعْمَالِنَا، مَنْ يَهْدِهِ اللَّهُ فَلَا مُضِلَّ لَهُ، وَمَنْ يُضْلِلْ فَلَا هَادِيَ لَهُ، وَأَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ، وَأَشْهَدُ أَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ» وَاللَّفْظُ لِحَدِيثِ الْأَعْمَشِ وَالْآخَرُونَ نَحْوَهُ.

3529- حَدَّثَنَا الحَسَنُ بْنُ عَرَفَةَ، قَالَ: حَدَّثَنَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ مُحَمَّدِ بْنِ زِيَادٍ، عَنْ أَبِي رَاشِدٍ الحُبْرَانِيِّ، قَالَ: أَتَيْتُ عَبْدَ اللهِ بْنَ عَمْرِو بْنِ العَاصِ، فَقُلْتُ لَهُ: حَدِّثْنَا مِمَّا سَمِعْتَ مِنْ رَسُولِ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَأَلْقَى إِلَيَّ صَحِيفَةً، فَقَالَ: هَذَا مَا كَتَبَ لِي رَسُولُ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: فَنَظَرْتُ فِيهَا فَإِذَا فِيهَا: إِنَّ أَبَا بَكْرٍ الصِّدِّيقَ قَالَ: يَا رَسُولَ اللهِ عَلِّمْنِي مَا أَقُولُ إِذَا أَصْبَحْتُ وَإِذَا أَمْسَيْتُ، فَقَالَ: يَا أَبَا بَكْرٍ قُلْ: اللَّهُمَّ فَاطِرَ السَّمَوَاتِ وَالأَرْضِ عَالِمَ الغَيْبِ وَالشَّهَادَةِ لاَ إِلَهَ إِلاَّ أَنْتَ رَبَّ كُلِّ شَيْءٍ وَمَلِيكَهُ، أَعُوذُ بِكَ مِنْ شَرِّ نَفْسِي، وَمِنْ شَرِّ الشَّيْطَانِ وَشِرْكِهِ، وَأَنْ أَقْتَرِفَ عَلَى نَفْسِي سُوءًا أَوْ أَجُرَّهُ إِلَى مُسْلِمٍ. هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ مِنْ هَذَا الوَجْهِ.
