Can I give sadqa e jariya for my deceased mom from my husbands money which he gives me for monthly expenses as sometimes not even a single money gets spent ?
In the Name of Allah, the Most Gracious, The Most Merciful.
As-salaamu `alaykum wa-ramatullahi wa-barakatuh.
If the monthly expense money belongs to your husband, you may give that money in sadaqa with the consent of your husband. If you are aware that your husband will not mind you giving sadaqa with his money, that is an indication of his consent which will suffice to give his money in sadaqa. Both of you will be rewarded for the sadaqa.[1]
Rasulullah salallahu alayhi wa sallam has said;
إِذَا أَنْفَقَتِ المَرْأَةُ مِنْ طَعَامِ بَيْتِهَا غَيْرَ مُفْسِدَةٍ، كَانَ لَهَا أَجْرُهَا بِمَا أَنْفَقَتْ، وَلِزَوْجِهَا أَجْرُهُ بِمَا كَسَبَ، وَلِلْخَازِنِ مِثْلُ ذَلِكَ، لاَ يَنْقُصُ بَعْضُهُمْ أَجْرَ بَعْضٍ شَيْئًا[2]
“When a wife spends from the food of her house without transgressing, she, her husband and the treasurer will all be rewarded equally. None of them will curtail the reward of the next”

شرح مختصر الطحاوي للجصاص (5/ 280)
قال أبو جعفر: (على الزوج نفقة زوجته، وكسوتها بالمعروف”.
والأصل فيه قول الله تعالى: {الرجال قوامون على النساء بما فضل الله بعضهم على بعض وبما أنفقوا من أموالهم}.
وقال تعالى: {وعلى المولود له رزقهن وكسوتهن بالمعروف}.
وقال النبي صلى الله عليه وسلم في خطبته المشهورة: “لهن عليكم رزقهن وكسوتهن بالمعروف”.
وعلى ذلك اتفاق أهل العلم.

فرق بين نفقة الولد وبين نفقة الزوجات، فإن المرأة وإن كانت موسرة فنفقتها على الزوج.
