Divorce query

Answered as per Hanafi Fiqh by Askimam.org

I got married in August 15th 2016 and within the first week of marriage I saw a text message on my wifes’ phone which made me really angry as it revealed her past to me, so we had a heated discussion and I said to her, “look, if you crash my car I can take it, if you burn my house I can take it, if you waste all of my money i can take it but if you chat with any guy behind my back then I have nothing to do with you” and by “then I have nothing to do with you” I meant divorce.

In 1st February 2017, I came across my wife’s phone records and I saw that she had been on phone to 2 different men behind my back in every month between from August 2016 – January 2017 and she admitted to all of this as well when I confronted her.

So my 2 questions are;

1. Has talaaq taken place here?

2. If so, when did it take place, when I found out which was in February 2017 or when it first happened behind my back in the end of August 2016?

Answer

In the Name of Allaah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

  1. Your statement “I have nothing to do with you” will constitute a talaaq baain as you intended divorce[1].
  2. The divorce took place when your wife chatted with another man in August 2016[2].
