Bleeding for 41 days

A woman started bleeding after the birth of her child. She bled for 35 days. Thereafter her bleeding stopped for a complete day. She started performing her salah. The next day (37th day) she started bleeding again. She is on the 41st day after birth. Will this be counted as Haydh or is it nifas until the 40th day and now it is regarded as istihadhah. In short is it necessary that the tohar days after nifas should be 15. Jazakallah

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

You did not state if the woman in reference is a first time mother or not and that she has a nifās habit or not.

  1. 1.     If a woman is experiencing her first nifās then the complete 40 days will be regarded as nifās and the exceeding amount will be regarded as istihadha. Similar to haidh, it is not necessary for a woman to see blood every single day during the period of nifās in order to establish the ahkam of nifās.
  2. 2.    If a woman had experienced nifās before, then any bleeding she has that is below her habit will become her new habit if there is no bleeding after 40 days. If the bleeding exceeds the habit, then it will either establish a new habit (if it is within the nisāb of nifās, i.e. 40 days) or it will revert back to the original habit (if the blood goes over the nisāb of nifās).
