I have read about halalah, but I do not want to go through that process. Is there any other option?

Talaq and halalah.. 

Salam. My husband gave me talaq a few times whilst he was drunk, when I mentioned it to him when he was sober, he said he didn’t say it n doesn’t remember it.. I had left him as a few people said it was done. And few people said it wasn’t.. I went back to him and stayed as a wife. And then I had a baby with him. The baby was a few months old and my husband started doing the same thing, giving me talaq in the influence of alcohol. Again wen asked he didn’t remember saying it. So I had left him again with our baby because family members had said divorce is done. Now we are in contact for the sake of the baby. I really love him and want to be back with him. I have read about halalah, but I do not want to go through that process.. is there any other option. Please I would be grateful if you kindly answer my question.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if a person pronounces talaq while he is drunk, the talaq is valid. If your husband pronounced talaq at least three times whether in one sitting or different sittings while being drunk, that constitutes Talaq-e-Mugallazah (a permanently irrevocable divorce). Talaq -e- Mugallazah terminates the nikah permanently. [1] [2] [3] [4]

Halalah is that after the divorcee spends her iddat of divorce, she marries another person. The new marriage is then consummated. If the second husband divorces his wife or passes away, the woman then waits for her iddat to finish. There after she may re-marry the first husband if she wishes to. [7]

(وإن كان الطلاق ثلاثا في الحرة أو ثنتين في الأمة لم تحل له حتى تنكح زوجا غيره نكاحا صحيحا ويدخل بها ثم يطلقها أو يموت عنها) والأصل فيه قوله تعالى {فإن طلقها فلا تحل له من بعد حتى تنكح زوجا غيره} [البقرة: 230]
