Thought of divorce when reading verses of divorce in the Qur’aan

Answered as per Hanafi Fiqh by Askimam.org

Salaamu Alaykum,

I sent a question August 15th but it hasn’t been answered. My question is

I like to read Surah Baqara.

When I read the ayat (At Talaqu Marataan), I get a waswasa from Shaytan that it is my wife and that I said the lafz talaq with intention of wife. But I say in my mind no. My intention is reading ayat only. I cant control a thought that comes in my mind from shaytan that its my wife. I iust respond no. So my question, is there a difference between thoughts and niya, and would talaq take place on this action because there is lafz and niyat. I feel it is lafz and waswasa not lafz and niya. Please answer and send directly to my email or publish the answer so I can read it. My email.is jawadhafid@yahoo.com.

Jazakum Allah khair

Answer

In the Name of Allaah, the Most Gracious, the Most Merciful.

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

Brother in Islaam,

The mere thought of your wife when reciting the divorce related verses of the Qur’aan does not constitute divorce[1].  You state that your intention is to recite the Qur’aan. Accordingly, your nikaah with your wife is intact.

Do not entertain any such thoughts of divorce. When the thought of divorce crosses your mind, consider them to be from Shaitaan and recite the following:

Translation: I seek refuge in Allaah from the rejected devil.

Translation: There is no power and no might except with Allaah.

If you are suffering paranoia of divorce and whispers from Shaitaan, and that is creating instability in your marriage, you should inform two adult males of your condition and make them your witness that you have no intention of divorcing your wife when you experience such thoughts. Thereafter, be rest assured of your marriage being intact. There is no need to refer to your wife on the issue.

And Allaah Ta’aala Knows Best.
