What is the Hanafi view on eating kidneys etc and joining prayers?

I have two questions

1) what is the standing on eating parts of kidneys, heart, testicles of of mutton or beef? Is it halal, makroo or haraam

2) I work in an office that is 120 kilometres away from the city so we offer Qasr Salat. Most of the Shafi followers offer their Zuhr and Asr Salat together. As per teachings of Hanafi Mazhab and scholars is it permissible to offer Zuhr and Asr at the same time i.e 2 rakat of Zuhr followed by 2 rakat of Asr when in state when Qasr Salat is applicable.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1)     The Fuqaha (Jurists) of the Hanafi Madhab have ruled that seven parts of an animal are prohibited for consumption. They are as follows:

  1. Flowing blood
  2. Male genitals
  3. Female genitals
  4. Testicles
  5. Glands
  6. Bladder
  7. Gall bladder

Hence, it will be permissible for you to consume the heart and kidneys of both Mutton and Beef and not the testicles. [1]

2) According to the Hanafi Madhab, it is not permissible to join two Salahs in one time. Every Salah must be performed in its prescribed time with the exception of Salah in Arafat and Muzdalifah. [2] Apparent joining of two Salah is permissible, not real joining. Apparent joining is to, for example, delay Dhuhr Salah until before its expiry time and perform Asr Salah immediately upon Asr Salah  time setting in. The same may be applied for Maghrib and Esha Salah. [3]

[1] وأما بيان ما يحرم أكله من أجزاء الحيوان المأكول فالذي يحرم أكله منه سبعة: الدم المسفوح، والذكر، والأنثيان، والقبل، والغدة، والمثانة، والمرارة لقوله عز شأنه {ويحل لهم الطيبات ويحرم عليهم الخبائث} [الأعراف: 157] وهذه الأشياء السبعة مما تستخبثه الطباع السليمة فكانت محرمة (بدائع الصنائع ج5 ص61 علمية).

قال – رحمه الله – (كره من الشاة الحياء والخصية والغدة والمثانة والمرارة والدم المسفوح والذكر) لما روى الأوزاعي عن واصل بن مجاهد قال «كره رسول الله – صلى الله عليه وسلم – من الشاة الذكر والأنثيين والقبل والغدة والمرارة والمثانة» قال أبو حنيفة الدم حرام وكره الستة وذلك لقوله تعالى {حرمت عليكم الميتة} [المائدة: 3] وكره ما سواه؛ لأنه مما تستخبثه النفس وتكرهه وهذا المعنى سبب الكراهة لقوله تعالى {ويحرم عليهم الخبائث} [الأعراف: 157](البحر ج8 ص485 رشيدية)

(كره تحريما) وقيل تنزيها والأول أوجه (من الشاة سبع الحياء والخصية والغدة والمثانة والمرارة والدم المسفوح والذكر) للأثر الوارد في كراهة ذلك (الدر المختار ج6 ص749 سعيد)

[2](ولا جمع بين فرضين في وقت بعذر) سفر ومطر خلافا للشافعي، وما رواه محمول على الجمع فعلا لا وقتا (فإن جمع فسد لو قدم) الفرض على وقته (وحرم لو عكس) أي أخره عنه (وإن صح) بطريق القضاء (إلا لحاج بعرفة ومزدلفة) (الدر المختار ج1 ص381 سعيد)

وعلى هذا الأصل قال أصحابنا: إنه لا يجوز الجمع بين فرضين في وقت أحدهما إلا بعرفة والمزدلفة فيجمع بين الظهر والعصر في وقت الظهر بعرفة، وبين المغرب والعشاء في وقت العشاء بمزدلفة، اتفق عليه رواة نسك رسول الله – صلى الله عليه وسلم – أنه فعله، ولا يجوز الجمع بعذر السفر والمطر.( بدائع الصنائع ج1 ص126 علمية)

[3](قوله: وما رواه) أي من الأحاديث الدالة على التأخير كحديث أنس «أنه – صلى الله عليه وسلم – كان إذا عجل السير يؤخر الظهر إلى وقت العصر فيجمع بينهما، ويؤخر المغرب حتى يجمع بينها وبين العشاء» وعن ابن مسعود مثله.(الدر المختار ج1 ص381 سعيد)
