Answered as per Hanafi Fiqh by Askimam.org

i would like to know the verdict if a man tells his wife in anger why you don’t take divorce divorce divorce &than repeated&sed take it& go, why you staying here. ..F off from here, I don’t need you in my life, get out &@ several different times also said the same tings……The divorce counts??

When I asked him about it he denies dat he said & he saying @ the time he said he gave twice but afta dat time…….A few times he told me d same tings so even if he saying he gave twice the 3rd time could hav been counted after dat time….1 minute he sayin he gave twice than he changing & saying he didnt say & he doesn’t know what he said& he saying he speaks in anger……

This hapend awile back& i gave him d benefit of the doubt, &i made dua 2 Allah that if he is lying&the divorce took place than Allah must just show me sumhow &take away my feelings 4 him/sumting because i had my doubts but i got a daughter& as i said i gave him benefit of the doubt…..things just never changed for d better&he hit me few times&he talks a whole lot of nonsense& it hapend again&again……..so if it was counted @ dat time wen he said it….The iddat period is over already…..do I hav2 sit in iddat??

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If your husband uttered the statements mentioned by you, then such words constitute a permanently irrevocable divorce. You are no longer his wife. As soon as he uttered those words your Iddat began. Therefore, if the period of three menses is over your Iddat is terminated.[1]
