Do I have to pay for the maintenance of my ex-wife

As salaam mu alaykum Mufti,

I have a query about maintenance for my ex-wife. I have been divorced for one year and have paid maintenance for my ex-wife and son during the iddat period. I have also been paying maintenance for my son since the end of the iddat period and have kept him on my medical aid.

My ex-wife is taking me to maintenance court with the claim that islamically I am responsible for maintaining her after the iddat period. I am currently paying R1600 /month for my one year old son’s expenses which include his food, milk, etc. Is there any Islamic responsibility on me to maintain my ex-wife? She is claiming an amount in excess of R4000 for her maintenance even though she is currently staying with her parents.

Is there also an amount for me to [pay for lodging if she is not staying with her parents?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

A husband is not required to maintain his ex-wife after the iddah period[1][2].

المحيط البرهاني في الفقه النعماني (3/ 466)

المعتدة من الطلاق لا تخرج من بيتها ليلاً ولا نهاراً، أما المتوفى عنها زوجها، فلا بأس بأن تخرج بالنهار لحاجتها، ولا تبيت في غير منزلها.

والفرق: أن نفقة المتوفى عنها زوجها عليها، وعسى لا تجد من يسوي أمرها، فتحتاج إلى الخروج لتسوية أمر معيشتها غير أن أمر المعيشة عادة تسوى بالنهار دون الليالي، فأبيح لها الخروج بالنهار دون الليالي.

وأما المطلقة فنفقتها في مال الزوج فلا تحتاج إلى الخروج

وَإِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ فَلَهَا النَّفَقَةُ وَالسُّكْنَى فِي عِدَّتِهَا رَجْعِيًّا كَانَ أَوْ بَائِنًا

عدت کے بعد وہ اجنبیۃ ہے، اس لۓ عدت کے بعد سے طلاق دینے والے کے ذمہ نفقہ واجب نہیں ہے – ( فتاوی دار العلوم زکریا، ج4، ص363 )

اور بچوں کا نان نفقۃ اس شخص کے ذمہ واجب ہے ( فتاوی محمودیۃ، ج13، ص466 )

البحر الرائق شرح كنز الدقائق ومنحة الخالق وتكملة الطوري (4/ 218)

أَيْ تَجِبُ النَّفَقَةُ وَالسُّكْنَى وَالْكِسْوَةُ لِوَلَدِهِ الصَّغِيرِ الْفَقِيرِ لِقَوْلِهِ تَعَالَى {وَعَلَى الْمَوْلُودِ لَهُ رِزْقُهُنَّ وَكِسْوَتُهُنَّ بِالْمَعْرُوفِ} [البقرة: 233] فَهِيَ عِبَارَةٌ فِي إيجَابِ نَفَقَةِ الْمَنْكُوحَاتِ إشَارَةً إلَى أَنَّ نَفَقَةَ الْأَوْلَادِ عَلَى الْأَب
